Chapter. If somebody lends something or sells it on credit or deposits it as a trust, and the new possessor gets the bankrupt, the former owner has a more right than the other creditors to restore that thing if he find it with the bankrupt.
And Hasan (may Allah have mercy on him) said: When someone becomes bankrupt and his (bankruptcy is) established in the court of the ruler, then it is not permissible for him to free any of his slaves, nor will his buying and selling be considered valid. Sa'id bin al-Musayyib said that 'Uthman (may Allah be pleased with him) had decided that whoever takes his right before the bankruptcy, then it becomes his. And whoever recognizes his own goods with him, then he is the one most entitled to them.
