The Book of Watering
بَابٌ في الشُّرْبِ، وَمَنْ رَأَى صَدَقَةَ الْمَاءِ وَهِبَتَهُ وَوَصِيَّتَهُ جَائِزَةً، مَقْسُومًا كَانَ أَوْ غَيْرَ مَقْسُومٍ:
(1b) Chapter. Whoever things that giving water in charity, or as a gift or by way of a testament is permissible, whether it is divided or not.
2بَابُ مَنْ قَالَ إِنَّ صَاحِبَ الْمَاءِ أَحَقُّ بِالْمَاءِ حَتَّى يَرْوَى:
(2) Chapter. Whoever said, " The owner of the water has the right to drink till he is satisfied, as a Prophet ﷺ said, Superfluous water should not be withheld from others.
3بَابُ مَنْ حَفَرَ بِئْرًا فِي مِلْكِهِ لَمْ يَضْمَنْ:
(3) Chapter. If one digs a well in his own land and somebody falls in it and dies, and owner is not reponsible.
4بَابُ الْخُصُومَةِ فِي الْبِئْرِ وَالْقَضَاءِ فِيهَا:
(4) Chapter. Disputes and controversies about wells and the settlement of such disputes and contraversies.
5بَابُ إِثْمِ مَنْ مَنَعَ ابْنَ السَّبِيلِ مِنَ الْمَاءِ:
(5) Chapter. The sin of him who withholds water from wayfarer and travellers.
6بَابُ سَكْرِ الأَنْهَارِ:
(6) Chapter. The dams of rivers.
7بَابُ شُرْبِ الأَعْلَى قَبْلَ الأَسْفَلِ:
(7) Chapter. The land near the source of water has the right to be irrigated before the one that is farther.
8بَابُ شِرْبِ الأَعْلَى إِلَى الْكَعْبَيْنِ:
(8) Chapter. The land nearer to the source of water has the right to be covered with water up to the ankles.
9بَابُ فَضْلِ سَقْيِ الْمَاءِ:
(9) Chapter. The superiority of providing water (to those who need it).
10بَابُ مَنْ رَأَى أَنَّ صَاحِبَ الْحَوْضِ وَالْقِرْبَةِ أَحَقُّ بِمَائِهِ:
(10) Chapter. Whoever thinks that the owner of a tank, or a leather water-containe has a more.
11بَابُ لاَ حِمَى إِلاَّ لِلَّهِ وَلِرَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:
(11) Chapter. No Hima (private pasture) except according to what Allah and His Messenger ﷺ did.
12بَابُ شُرْبِ النَّاسِ وَالدَّوَابِّ مِنَ الأَنْهَارِ:
(12) Chapter. Drinking water by people and watering animals from the rivers.
13بَابُ بَيْعِ الْحَطَبِ وَالْكَلإِ:
(13) Chapter. The selling of wood and grass.
14بَابُ الْقَطَائِعِ:
(14) Chapter. The uncultivated pieces of land (granted by the ruler to some individuals).
15بَابُ كِتَابَةِ الْقَطَائِعِ:
(15) Chapter. Documentation of the land grants.
16بَابُ حَلَبِ الإِبِلِ عَلَى الْمَاءِ:
(16) Chapter. Milking she-camels at water places.
17بَابُ الرَّجُلِ يَكُونُ لَهُ مَمَرٌّ، أَوْ شِرْبٌ فِي حَائِطٍ أَوْ فِي نَخْلٍ
(17) Chapter. One may have the right to pass through a garden or to have a share in date-palms.
