The Book of Cultivation and Agriculture

بَابُ مَنْ أَحْيَا أَرْضًا مَوَاتًا:

Chapter. Whoever Cultivating the neglected uncultivated land belonging to nobody (will own it).

Hadith 2335
حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ ، حَدَّثَنَا اللَّيْثُ ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي جَعْفَرٍ ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ أَعْمَرَ أَرْضًا لَيْسَتْ لِأَحَدٍ فَهُوَ أَحَقُّ " . قَالَ عُرْوَةُ : قَضَى بِهِ عُمَرُ رَضِيَ اللَّهُ عَنْهُ فِي خِلَافَتِهِ .
Narrated `Aisha: The Prophet said, "He who cultivates land that does not belong to anybody is more rightful (to own it)." `Urwa said, "`Umar gave the same verdict in his Caliphate."
وَرَأَى ذَلِكَ عَلِيٌّ فِي أَرْضِ الْخَرَابِ بِالْكُوفَةِ مَوَاتٌ ، وَقَالَ عُمَرُ : مَنْ أَحْيَا أَرْضًا مَيِّتَةً فَهِيَ لَهُ ، وَيُرْوَى عَنْ عَمْرِو بْنِ عَوْفٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَقَالَ فِي غَيْرِ حَقِّ مُسْلِمٍ وَلَيْسَ لِعِرْقٍ ظَالِمٍ فِيهِ حَقٌّ ، وَيُرْوَى فِيهِ ، عَنْ جَابِرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
And ‘Ali (may Allah be pleased with him) gave the same order in Kufa regarding the cultivation of deserted lands. And ‘Umar (may Allah be pleased with him) said that whoever revives barren land, it becomes his. And the same narration is reported from ‘Umar (may Allah be pleased with him) and Ibn ‘Awf (may Allah be pleased with him). However, Ibn ‘Awf (may Allah be pleased with him) added in his narration from the Prophet (peace and blessings of Allah be upon him) that it is on the condition that the (uncultivated land) does not belong to any Muslim, and the oppressor who claims a vein (right) in the land has no right in it. And in this regard, there is also a similar narration from Jabir (may Allah be pleased with him) from the Prophet (peace and blessings of Allah be upon him).
