Narrated Ibn `Umar from Zaid bin Thabit: Allah's Apostle allowed the sale of 'Araya by estimating the dates on them for measured amounts of dried dates. Musa bin `Uqba said, "Al- 'Araya were distinguished date palms; one could come and buy them (i.e. their fruits).
Imam Malik, may Allah have mercy on him, said that ‘Ariyyah is when a person (the owner of a garden) gives another person a date palm tree (as a gift) in his garden, then it does not seem good for that person to come to the garden, so in this case, he may buy back his tree (which he had gifted) in exchange for dried dates; this has been permitted for him. And Ibn Idris (Imam Shafi’i, may Allah have mercy on him) said that ‘Ariyyah is not permissible except (when it is less than five wasqs) and the dried dates are measured and exchanged hand to hand; it should not be that both sides are estimated. And this is supported by the statement of Sahl bin Abi Hathmah, may Allah be pleased with him, that the dates should be given by measure of wasq. Ibn Ishaq, may Allah have mercy on him, narrated in his hadith from Nafi’, and he narrated from Ibn ‘Umar, may Allah be pleased with them both, that ‘Ariyyah is when a person gives one or two date palm trees in his garden to someone as a loan. And Yazid narrated from Sufyan bin Husayn that ‘Ariyyah refers to the date palm tree that is given to the poor for the sake of Allah, but they cannot wait for the dates to ripen, so the Prophet, peace and blessings be upon him, permitted them to sell it for as much dried dates as they wish and to whomever they wish.
