كتاب البيوعThe Book of Sales (Bargains)
بَابُ بَيْعِ الْمُزَابَنَةِ، وَهْيَ بَيْعُ الثَّمَرِ بِالتَّمْرِ وَبَيْعُ الزَّبِيبِ بِالْكَرْمِ وَبَيْعُ الْعَرَايَا:
Chapter. The sale called Al-Muzabana; which is sale of dried dates for fresh ones (that are still on the trees), and dried grapes for fresh grapes and the sale called Al-Araya (i.e., the selling of ripe fresh date, still over the palms, by means of estimation, for dry date)
Hadith 2183
حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ ، حَدَّثَنَا اللَّيْثُ ، عَنْ عُقَيْلٍ ، عَنِ ابْنِ شِهَابٍ ، أَخْبَرَنِي سَالِمُ بْنُ عَبْدِ اللَّهِ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ ، وَلَا تَبِيعُوا الثَّمَرَ بِالتَّمْرِ " .
Narrated `Abdullah bin `Umar: Allah's Apostle said, "Do not sell fruits of dates until they become free from all the dangers of being spoilt or blighted; and do not sell fresh dates for dry dates."
قَالَ أَنَسٌ : نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ .
Anas (may Allah be pleased with him) said that the Prophet (peace and blessings of Allah be upon him) forbade Muzabana and Muhaqala.
Hadith 2183
قَالَ أَنَسٌ : نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ .
Anas (may Allah be pleased with him) said that the Prophet (peace and blessings of Allah be upon him) forbade Muzabana and Muhaqala.

Hadith 2184
قَالَ سَالِمٌ : وَأَخْبَرَنِي عَبْدُ اللَّهِ ، عَنْ زَيْدِ بْنِ ثَابِتٍ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَخَّصَ بَعْدَ ذَلِكَ فِي بَيْعِ الْعَرِيَّةِ بِالرُّطَبِ أَوْ بِالتَّمْرِ ، وَلَمْ يُرَخِّصْ فِي غَيْرِهِ .
Narrated Salim and `Abdullah from Zaid bin Habit' "Later on Allah's Apostle permitted the selling of ripe fruits on trees for fresh dates or dried dates in Bai'-al-'Araya, and did not allow it for any other kind of sale."
Hadith 2185
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " نَهَى عَنْ الْمُزَابَنَةِ وَالْمُزَابَنَةُ ، اشْتِرَاءُ الثَّمَرِ بِالتَّمْرِ كَيْلًا ، وَبَيْعُ الْكَرْمِ بِالزَّبِيبِ كَيْلًا " .
Narrated `Abdullah bin `Umar: Allah's Apostle forbade Muzabana; and Muzabana means the selling of fresh dates (on the trees) for dried dates by measure and also the selling of fresh grapes for dried grapes by measure.
Hadith 2186
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ ، عَنْ أَبِي سُفْيَانَ مَوْلَى ابْنِ أَبِي أَحْمَدَ ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ رَضِيَ اللَّهُ عَنْهُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " نَهَى عَنْ الْمُزَابَنَةِ ، وَالْمُحَاقَلَةِ ، وَالْمُزَابَنَةُ اشْتِرَاءُ الثَّمَرِ بِالتَّمْرِ فِي رُءُوسِ النَّخْلِ " .
Narrated Abu Sa`id Al-Khudri: Allah's Apostle forbade Muzabana and Muhaqala; and Muzabana means the selling of ripe dates for dates still on the trees.
Hadith 2187
حَدَّثَنَا مُسَدَّدٌ حَدَّثَنَا أَبُو مُعَاوِيَةَ ، عَنِ الشَّيْبَانِيِّ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ الْمُحَاقَلَةِ ، وَالْمُزَابَنَةِ " .
Narrated Ibn `Abbas: The Prophet forbade Muzabana and Muhaqala.
Hadith 2188
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ ، حَدَّثَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ ابْنِ عُمَرَ ، عَنْ زَيْدِ بْنِ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُمْ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " أَرْخَصَ لِصَاحِبِ الْعَرِيَّةِ أَنْ يَبِيعَهَا بِخَرْصِهَا " .
Narrated Zaid bin Thabit: Allah's Apostle al lowed the owner of 'Araya to sell the fruits on the trees by means of estimation.
