The Book of Sales (Bargains)

بَابُ إِذَا بَيَّنَ الْبَيِّعَانِ وَلَمْ يَكْتُمَا وَنَصَحَا:

Chapter. If both the seller and buyer explain the good and bad points of the transaction and hide nothing and give sincere advice (then they are blessed in their bargain).

Hadith 2079
حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا شُعْبَةُ ، عَنْ قَتَادَةَ ، عَنْ صَالِحٍ أَبِي الْخَلِيلِ ، عَنْ عَبْدِ اللَّهِ بْنِ الْحَارِثِ ، رَفَعَهُ إِلَى حَكِيمِ بْنِ حِزَامٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا ، أَوْ قَالَ حَتَّى يَتَفَرَّقَا ، فَإِنْ صَدَقَا وَبَيَّنَا ، بُورِكَ لَهُمَا فِي بَيْعِهِمَا ، وَإِنْ كَتَمَا وَكَذَبَا ، مُحِقَتْ بَرَكَةُ بَيْعِهِمَا " .
Narrated Hakim bin Hizam: Allah's Apostle said, "The seller and the buyer have the right to keep or return goods as long as they have not parted or till they part; and if both the parties spoke the truth and described the defects and qualities (of the goods), then they would be blessed in their transaction, and if they told lies or hid something, then the blessings of their transaction would be lost."
وَيُذْكَرُ عَنْ الْعَدَّاءِ بْنِ خَالِدٍ ، قَالَ : كَتَبَ لِي النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ هَذَا مَا اشْتَرَى مُحَمَّدٌ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ الْعَدَّاءِ بْنِ خَالِدٍ بَيْعَ الْمُسْلِمِ مِنَ الْمُسْلِمِ ، لَا دَاءَ ، وَلَا خِبْثَةَ ، وَلَا غَائِلَةَ ، وَقَالَ قَتَادَةُ : الْغَائِلَةُ الزِّنَا ، وَالسَّرِقَةُ ، وَالْإِبَاقُ ، وَقِيلَ لِإِبْرَاهِيمَ : إِنَّ بَعْضَ النَّخَّاسِينَ يُسَمِّي آرِيَّ خُرَاسَانَ وَسِجِسْتَانَ ، فَيَقُولُ : جَاءَ أَمْسِ مِنْ خُرَاسَانَ ، جَاءَ الْيَوْمَ مِنْ سِجِسْتَانَ فَكَرِهَهُ كَرَاهِيَةً شَدِيدَةً ، وَقَالَ عُقْبَةُ بْنُ عَامِرٍ : لَا يَحِلُّ لِامْرِئٍ يَبِيعُ سِلْعَةً يَعْلَمُ أَنَّ بِهَا دَاءً إِلَّا أَخْبَرَهُ .
And it is narrated from ‘Adā’ bin Khālid (may Allah be pleased with him) that he said: The Prophet (peace and blessings of Allah be upon him) wrote a contract of sale for me, stating: “This is the document in which Muhammad, the Messenger of Allah (peace and blessings of Allah be upon him), declares the purchase from ‘Adā’ bin Khālid. This is the sale of a Muslim to a Muslim, by his own hand. There is no defect in it, nor any deception, nor immorality, nor any evil intent.” And Qatādah (may Allah have mercy on him) said: “Ghā’ilah” refers to adultery, theft, and the habit of running away. Someone said to Ibrāhīm al-Nakha‘ī (may Allah have mercy on him) that some brokers name their stables “Ārī Khurāsān and Sijistān” (the Khurāsān stable and the Sijistān stable), and (to deceive) say: “Such-and-such an animal just arrived from Khurāsān yesterday,” and “Such-and-such just arrived from Sijistān today.” So Ibrāhīm al-Nakha‘ī heard this with great displeasure. ‘Uqbah bin ‘Āmir said: “It is not permissible for anyone to sell a commodity, knowing that it has a defect, without informing the buyer about it.”
