بَابُ مَنْ قَالَ لَيْسَ عَلَى الْمُحْصَرِ بَدَلٌ:

Chapter. Whoever said that the Muhsar is not supposed to perform Umm or Hajj in lieu of the prevented one.

Hadith 1813
حَدَّثَنَا إِسْمَاعِيلُ ، قَالَ : حَدَّثَنِي مَالِكٌ ، عَنْ نَافِعٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " حِينَ خَرَجَ إِلَى مَكَّةَ مُعْتَمِرًا فِي الْفِتْنَةِ ، إِنْ صُدِدْتُ عَنِ الْبَيْتِ صَنَعْنَا كَمَا صَنَعْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَهَلَّ بِعُمْرَةٍ مِنْ أَجْلِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، كَانَ أَهَلَّ بِعُمْرَةٍ عَامَ الْحُدَيْبِيَةِ ، ثُمَّ إِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ نَظَرَ فِي أَمْرِهِ ، فَقَالَ : مَا أَمْرُهُمَا إِلَّا وَاحِدٌ ، فَالْتَفَتَ إِلَى أَصْحَابِهِ ، فَقَالَ : مَا أَمْرُهُمَا إِلَّا وَاحِدٌ ، أُشْهِدُكُمْ أَنِّي قَدْ أَوْجَبْتُ الْحَجَّ مَعَ الْعُمْرَةِ ، ثُمَّ طَافَ لَهُمَا طَوَافًا وَاحِدًا ، وَرَأَى أَنَّ ذَلِكَ مُجْزِيًا عَنْهُ وَأَهْدَى " .
Narrated Nafi`: When `Abdullah bin `Umar set out for Mecca with the intentions performing `Umra in the period of afflictions, he said, "If I should be prevented from reaching the Ka`ba, then I would do the same as we did while in the company of Allah's Apostle ." So, he assumed the Ihram for `Umra since the Prophet had assumed the Ihram for `Umra in the year of Al-Hudaibiya. Then `Abdullah bin `Umar thought about it and said, "The conditions for both Hajj and `Umra are similar." He then turned towards his companions and said, "The conditions of both Hajj and `Umra are similar and I make you witnesses that I have made the performance of Hajj obligatory for myself along with `Umra." He then performed one Tawaf (between As-Safa and Al-Marwa) for both of them (i.e. Hajj and (`Umra) and considered that to be sufficient for him and offered a Hadi.
وَقَالَ رَوْحٌ : عَنْ شِبْلٍ ، عَنِ ابْنِ أَبِي نَجِيحٍ ، عَنْ مُجَاهِدٍ ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ ، " إِنَّمَا الْبَدَلُ عَلَى مَنْ نَقَضَ حَجَّهُ بِالتَّلَذُّذِ ، فَأَمَّا مَنْ حَبَسَهُ عُذْرٌ ، أَوْ غَيْرُ ذَلِكَ ، فَإِنَّهُ يَحِلُّ وَلَا يَرْجِعُ ، وَإِنْ كَانَ مَعَهُ هَدْيٌ وَهُوَ مُحْصَرٌ نَحَرَهُ ، إِنْ كَانَ لَا يَسْتَطِيعُ أَنْ يَبْعَثَ بِهِ ، وَإِنِ اسْتَطَاعَ أَنْ يَبْعَثَ بِهِ لَمْ يَحِلَّ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ ". وَقَالَ مَالِكٌ ، وَغَيْرُهُ : يَنْحَرُ هَدْيَهُ وَيَحْلِقُ فِي أَيِّ مَوْضِعٍ كَانَ ، وَلَا قَضَاءَ عَلَيْهِ ، لِأَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَصْحَابَهُ بِالْحُدَيْبِيَةِ نَحَرُوا ، وَحَلَقُوا ، وَحَلُّوا مِنْ كُلِّ شَيْءٍ قَبْلَ الطَّوَافِ ، وَقَبْلَ أَنْ يَصِلَ الْهَدْيُ إِلَى الْبَيْتِ ، ثُمَّ لَمْ يُذْكَرْ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَ أَحَدًا أَنْ يَقْضُوا شَيْئًا ، وَلَا يَعُودُوا لَهُ ، وَالْحُدَيْبِيَةُ خَارِجٌ مِنْ الْحَرَمِ .
And Ruh said, from them Shibl bin ‘Iyad, from them Ibn Abi Najih, from them Mujahid, and from them Ibn ‘Abbas (may Allah be pleased with them both) that expiation (qada) becomes obligatory when someone, during Hajj, has intercourse with his wife and thereby breaks the intention of Hajj. But if some other excuse arises, or something else happens, then he becomes lawful (halal), and expiation is not necessary for him. And if he had a sacrificial animal with him and he was prevented (from reaching the Haram) and could not send it to the Haram, then he should slaughter it (wherever he is staying). This is in the case when he does not have the ability to send the sacrificial animal to the Haram, but if he has the ability, then he cannot exit the state of ihram until the sacrifice is slaughtered there. Imam Malik and others said that (the one prevented) should slaughter his sacrifice wherever he is, and shave his head, wherever he may be. Expiation is not obligatory upon him, because the Prophet (peace and blessings of Allah be upon him) and his companions (may Allah be pleased with them) at Hudaybiyyah, without performing tawaf and without reaching the House of Allah, slaughtered (their sacrifices) and shaved their heads, and they became lawful from everything. Then no one mentioned that the Prophet (peace and blessings of Allah be upon him) ordered anyone to make up (qada) or repeat anything, and Hudaybiyyah is outside the boundary of the Haram.
