Hadith 6969

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا سُفْيَانُ ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنِ الْقَاسِمِ ، " أَنَّ امْرَأَةً مِنْ وَلَدِ جَعْفَرٍ تَخَوَّفَتْ أَنْ يُزَوِّجَهَا وَلِيُّهَا وَهِيَ كَارِهَةٌ ، فَأَرْسَلَتْ إِلَى شَيْخَيْنِ مِنَ الْأَنْصَارِ ، عَبْدِ الرَّحْمَنِ ، وَمُجَمِّعٍ ابْنَيْ جَارِيَةَ ، قَالَا : فَلَا تَخْشَيْنَ ، فَإِنَّ خَنْسَاءَ بِنْتَ خِذَامٍ أَنْكَحَهَا أَبُوهَا وَهِيَ كَارِهَةٌ ، فَرَدَّ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ذَلِكَ " ، قَالَ سُفْيَانُ : وَأَمَّا عَبْدُ الرَّحْمَنِ فَسَمِعْتُهُ يَقُولُ : عَنْ أَبِيهِ ، إِنَّ خَنْسَاءَ .
Narrated Al-Qasim: A woman from the offspring of Ja`far was afraid lest her guardian marry her (to somebody) against her will. So she sent for two elderly men from the Ansar, `AbdurRahman and Mujammi', the two sons of Jariya, and they said to her, "Don't be afraid, for Khansa' bint Khidam was given by her father in marriage against her will, then the Prophet cancelled that marriage." If young girls are married off in their childhood and, upon reaching maturity, they dislike this marriage, then their marriage will also be annulled.

Benefits and Issues:
➊ If the marriage of a previously married woman (thayyib) is conducted against her will, the marriage is still considered valid; however, she can have this marriage annulled through the court.

➋ To avoid this unpleasant outcome, it is better to reach a mutual understanding beforehand, that is, the marriage should take place where the woman is also agreeable and the guardian has no objection.
