Hadith 6948

كَرْهٌ وَكُرْهٌ وَاحِدٌ.
The meanings of «كرها» and «كرها» are the same.
حَدَّثَنَا حُسَيْنُ بْنُ مَنْصُورٍ ، حَدَّثَنَا أَسْبَاطُ بْنُ مُحَمَّدٍ ، حَدَّثَنَا الشَّيْبَانِيُّ سُلَيْمَانُ بْنُ فَيْرُوزٍ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ الشَّيْبَانِيُّ ،وَحَدَّثَنِي عَطَاءٌ أَبُو الحَسَنِ السُّوَائِيُّ ، وَلَا أَظُنُّهُ إِلَّا ذَكَرَهُ عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا : يَأَيُّهَا الَّذِينَ آمَنُوا لا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النِّسَاءَ كَرْهًا سورة النساء آية 19 الْآيَةَ ، قَالَ : " كَانُوا إِذَا مَاتَ الرَّجُلُ كَانَ أَوْلِيَاؤُهُ أَحَقَّ بِامْرَأَتِهِ ، إِنْ شَاءَ بَعْضُهُمْ تَزَوَّجَهَا ، وَإِنْ شَاءُوا زَوَّجَهَا ، وَإِنْ شَاءُوا لَمْ يُزَوِّجْهَا ، فَهُمْ أَحَقُّ بِهَا مِنْ أَهْلِهَا ، فَنَزَلَتْ هَذِهِ الْآيَةُ فِي ذَلِكَ " .
Narrated Ibn `Abbas: Regarding the Qur'anic Verse: 'O you who believe! You are forbidden to inherit women against their will.' (4.19) The custom (in the Pre-lslamic Period) was that if a man died, his relatives used to have the right to inherit his wife, and if one of them wished, he could marry her, or they could marry her to somebody else, or prevent her from marrying if they wished, for they had more right to dispose of her than her own relatives. Therefore this Verse was revealed concerning this matter.

Hadith Commentary:

In the noble verse mentioned in the hadith, the prohibition of coercion and compulsion upon women is stated.
In any case, compulsion and coercion are not permissible in Islam.
The Qur’an itself has said:
﴿لاَ إِكْرَاهَ فِي الدِّينِ﴾ “There is no compulsion in religion.”
(al-Baqarah: 256/2)

Ibn Battal, quoting from Muhallab, has said that from this hadith it is also understood that whoever detains a woman out of greed so that she dies and thus he becomes her heir to her wealth and property, such an act is prohibited by the explicit text of the Qur’an.
However, Hafiz Ibn Hajar rahimahullah writes that this is not established from the apparent meaning of the verse.
