Hadith 6840

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ ، حَدَّثَنَا عَبْدُ الْوَاحِدِ ، حَدَّثَنَا الشَّيْبَانِيُّ سَأَلْتُ عَبْدَ اللَّهِ بْنَ أَبِي أَوْفَى " عَنْ الرَّجْمِ ، فَقَالَ : رَجَمَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقُلْتُ : أَقَبْلَ النُّورِ أَمْ بَعْدَهُ ؟ قَالَ : لَا أَدْرِي ؟ " ، تَابَعَهُ عَلِيُّ بْنُ مُسْهِرٍ ، وَخَالِدُ بْنُ عَبْدِ اللَّهِ ، وَالْمُحَارِبِيُّ ، وَعَبِيدَةُ بْنُ حُمَيْدٍ ، عَنْ الشَّيْبَانِيِّ ، وَقَالَ بَعْضُهُمْ : الْمَائِدَةِ ، وَالْأَوَّلُ أَصَحُّ .
Narrated Ash-Shaibani: I asked `Abdullah bin Abi `Aufa about the Rajam (stoning somebody to death for committing illegal sexual intercourse). He replied, "The Prophet carried out the penalty of Rajam," I asked, "Was that before or after the revelation of Surat-an-Nur?" He replied, "I do not know."

Chapter of Sahih Bukhari Hadith Number: 6840: «بَابُ أَحْكَامِ أَهْلِ الذِّمَّةِ وَإِحْصَانِهِمْ إِذَا زَنَوْا وَرُفِعُوا إِلَى الإِمَامِ
Relevance between the Chapter Heading and the Hadith:
Apparently, there does not seem to be any relevance between the hadith and the chapter heading, because the chapter heading mentions the dhimmis (non-Muslim citizens under Muslim rule), whereas there is no mention of any dhimmi under the chapter. The narration which Imam Bukhari rahimahullah relates from Sayyiduna Abdullah bin Abi Awfa radi Allahu anhu, regarding this Hafiz Ibn Hajar rahimahullah writes:
«والذى ظهر لي أنه جرى على عادته فى الإشارة إلى ما ورد فى بعض طرق الحديث، و هو ما أخرجه أحمد و الإسماعيلي و الطبراني من طريق هشيم عن الشيباني قال: قلت هل رجم النبى صلى الله عليه وسلم؟ فقال: نعم رجم يهوديا و يهودية.» [فتح الساري 141/13]
“In my view, it is apparent that Imam Bukhari rahimahullah, according to his usual practice, has alluded to other chains of this hadith, which have been narrated by Ahmad, Isma‘ili, and Tabarani, that I asked: ‘Did the Prophet sallallahu alayhi wa sallam ever carry out stoning (rajm)?’ He replied: ‘Yes, he stoned a Jewish man and woman.’”
Hafiz Ibn Hajar rahimahullah clarified that in the hadith to which Imam Bukhari rahimahullah has alluded, there is a clear mention of the Jewish man and woman. Through this, the relevance between the chapter heading and the hadith is established.

Hadith Commentary:
Apparently, reconciling this hadith with the chapter heading’s translation is difficult, but Imam Bukhari rahimahullah, in accordance with his usual practice, has alluded to another chain of this hadith.
This has been mentioned by Imam Ahmad and Tabarani, among others.
In that narration, it is stated that the Prophet sallallahu alayhi wa sallam stoned a Jewish man and a Jewish woman.
From the statement of Abdullah ibn Abi Awfa radi Allahu anhu, it is understood that when a scholar does not know something well, he should say, “I do not know,” and there is no fault in this. Whoever, considering it a fault, tries to answer every question of the questioner is a fool, not a scholar.

Imam Bukhari rahimahullah, in accordance with his usual practice, has alluded to other chains of transmission (turuq) of this hadith. In those, it is mentioned that the Messenger of Allah sallallahu alayhi wa sallam stoned a Jewish man and woman. In this way, the relevance of the hadith to the chapter heading also becomes clear.

In Surah al-Ma'idah it is stated:
"And how do they make you a judge while they have the Torah, in which is Allah's judgment, yet they turn away from it." ( al-Ma'idah: 5:43)
This verse was also revealed regarding the Jews' adultery and the judgment concerning it. Therefore, the narrator was uncertain whether the decision of the Messenger of Allah sallallahu alayhi wa sallam to stone the Jews was before or after the revelation of Surah al-Ma'idah.

Imam Bukhari rahimahullah decided that the matter related to Surah al-Nur is more correct.
In any case, the stoning of the Jewish man and woman by the Messenger of Allah sallallahu alayhi wa sallam was after the revelation of Surah al-Nur.
We have already mentioned the evidences and indications for this earlier.
