Hadith 6816

قَالَ ابْنُ شِهَابٍ : فَأَخْبَرَنِي مَنْ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ ، قَالَ : فَكُنْتُ فِيمَنْ رَجَمَهُ ، فَرَجَمْنَاهُ بِالْمُصَلَّى ، فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ هَرَبَ ، فَأَدْرَكْنَاهُ بِالْحَرَّةِ ، فَرَجَمْنَاهُ .
Jabir bin `Abdullah said: I was among the ones who participated in stoning him and we stoned him at the Musalla. When the stones troubled him, he fled, but we over took him at Al-Harra and stoned him to death.

Hadith Commentary:
In one narration, it is mentioned that when the Messenger of Allah (sallallahu alayhi wa sallam) was informed of this, he said: "Why did you not leave him? Perhaps he would have repented and Allah would have forgiven his sin." This has been narrated by Abu Dawud, and al-Hakim and al-Tirmidhi have declared it authentic. From this hadith, it is understood that if the one who confesses runs away at the time of stoning (rajm), then the punishment of stoning is dropped.

The Messenger of Allah (sallallahu alayhi wa sallam) first asked about this matter by inquiring, "Are you insane?" because no person of sound mind would make such an admission and confession by which he would be annihilated from this world. However, this man's conscience had been awakened. He knew well that by dying in this manner, he would be cleansed of this crime. After his confession, the Messenger of Allah (sallallahu alayhi wa sallam) inquired from his family whether this person was insane, and the people unanimously testified that he was extremely intelligent. In short, the Prophet (sallallahu alayhi wa sallam) conducted a thorough investigation in this matter, as will be further clarified ahead. After this, he ordered him to be stoned (rajm).

Imam Bukhari (rahimahullah) has established from this hadith that the punishment of stoning (rajm) should not be carried out on an insane person until he regains his senses. (Fath al-Bari: 12/150)
