Hadith 6778

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عَبْدِ الْوَهَّابِ ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ ، حَدَّثَنَا سُفْيَانُ ، حَدَّثَنَا أَبُو حَصِينٍ ، سَمِعْتُ عُمَيْرَ بْنَ سَعِيدٍ النَّخَعِيَّ ، قَالَ : سَمِعْتُ عَلِيَّ بْنَ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " مَا كُنْتُ لِأُقِيمَ حَدًّا عَلَى أَحَدٍ فَيَمُوتَ فَأَجِدَ فِي نَفْسِي ، إِلَّا صَاحِبَ الْخَمْرِ : فَإِنَّهُ لَوْ مَاتَ وَدَيْتُهُ ، وَذَلِكَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : لَمْ يَسُنَّهُ " .
Narrated `Ali bin Abi Talib: I would not feel sorry for one who dies because of receiving a legal punishment, except the drunk, for if he should die (when being punished), I would give blood money to his family because no fixed punishment has been ordered by Allah's Apostle for the drunk.

Since the Messenger of Allah (sallallahu alayhi wa sallam) did not prescribe a fixed number of lashes for the drunkard, if a drunkard dies while being flogged, or if he dies after receiving more than forty lashes, then in this case his blood money (diyah) will be paid, and this diyah will be upon the ‘aqilah (male agnate relatives) of the ruler of the time.

Imam Shafi‘i (rahimahullah) states that if death occurs due to shoes or sticks instead of lashes, then in this case diyah will not be paid.

In our context, a special cane is prepared specifically for flogging; there is a particular person assigned to administer the punishment who practices regularly. The cane is soaked repeatedly before use so that it cuts the body like a knife. The criminal is stripped and tied up so that he cannot even writhe.

When the executioner comes running to strike and hits with full force on the buttocks, to the extent that the flesh becomes minced and flies off.

At times, even the bone becomes visible.

Those who administer such “civilized” punishments call the punishments of Islam barbaric.

We can only be astonished at this.
