Hadith 6734

حَدَّثَنَا مَحْمُودُ بْنُ غَيْلَانَ ، حَدَّثَنَا أَبُو النَّضْرِ ، حَدَّثَنَا أَبُو مُعَاوِيَةَ شَيْبَانُ ، عَنْ أَشْعَثَ ، عَنْ الْأَسْوَدِ بْنِ يَزِيدَ ، قَالَ : " أَتَانَا مُعَاذُ بْنُ جَبَلٍ ، بِالْيَمَنِ مُعَلِّمًا وَأَمِيرًا ، فَسَأَلْنَاهُ عَنْ رَجُلٍ تُوُفِّيَ وَتَرَكَ ابْنَتَهُ وَأُخْتَهُ ، فَأَعْطَى الِابْنَةَ النِّصْفَ ، وَالْأُخْتَ النِّصْفَ " .
Narrated Al-Aswad bin Yazid: Mu`adh bin Jabal came to us in Yemen as a tutor and a ruler, and we (the people of Yemen) asked him about (the distribution of the property of ) a man who had died leaving a daughter and a sister. Mu`adh gave the daughter one-half of the property and gave the sister the other half.

In one narration, it is mentioned that Mu'adh ibn Jabal radi Allahu anhu made the aforementioned decision during the blessed era of the Messenger of Allah sallallahu alayhi wa sallam.
(Sahih al-Bukhari, Hadith: 6741)
It has already been stated in the Book of Zakat that the Messenger of Allah sallallahu alayhi wa sallam appointed Mu'adh ibn Jabal radi Allahu anhu as the governor of Yemen.
In another narration, it is mentioned that when Mu'adh ibn Jabal radi Allahu anhu made the aforementioned decision, the Messenger of Allah sallallahu alayhi wa sallam was alive and present in Madinah al-Tayyibah.

Al-Aswad narrated this hadith at the time when Abdullah ibn al-Zubayr radi Allahu anhuma made a decision regarding a daughter and a sister, that the daughter would receive half and the remainder would go to the other agnates (asaba).

In the principles of inheritance, a daughter makes a sister an agnate (asaba). Therefore, if a person dies leaving behind a daughter and a sister, then according to the Qur'anic verse, the daughter receives half, and according to the hadith, the remaining half is given to the sister as an agnate (asaba).
