Hadith 6686

حَدَّثَنَا مُحَمَّدُ بْنُ مُقَاتِلٍ ، أَخْبَرَنَا عَبْدُ اللَّهِ ، أَخْبَرَنَا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ ، عَنْ الشَّعْبِيِّ ، عَنْ عِكْرِمَةَ ، عَنْ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، عَنْ سَوْدَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَتْ : " مَاتَتْ لَنَا شَاةٌ فَدَبَغْنَا مَسْكَهَا ، ثُمَّ مَا زِلْنَا نَنْبِذُ فِيهِ حَتَّى صَارَ شَنًّا " .
Narrated Sauda: (the wife of the Prophet) One of our sheep died and we tanned its skin and kept on infusing dates in it till it was a worn out water skin.

Hadith Commentary:
In any case, the use of nabidh has been established.
After the passing of Khadijah radi Allahu anha, Sawdah radi Allahu anha entered into marriage with the Prophet sallallahu alayhi wa sallam.
She passed away in 54 AH.

In the hadith of Sahl radi Allahu anhu, there is mention of "naqī‘", and in the hadith of Sawdah radi Allahu anhuma, there is mention of "nabīdh". Nabīdh or naqī‘ refers to that beverage which is obtained by soaking dates or grapes in water. Drinking such nabīdh is permissible. Dates would be soaked for the Messenger of Allah sallallahu alayhi wa sallam at night, and he would drink their beverage during the day; and if dates were soaked during the day, he would drink their beverage at night.

Imam Abu Hanifah rahimahullah also refers to the water of dates as nabīdh, but "talā’", "sikr", and "‘asīr" have, in common usage, come to be known by separate names. Therefore, in customary usage, they are not called nabīdh, and the rulings regarding oaths also depend on customary usage. Thus, after taking an oath not to drink nabīdh, drinking talā’, sikr, or ‘asīr will not break the oath. It appears that Imam Bukhari rahimahullah is also supporting the Hanafis in this regard.
