فَدَخَلَ الْأَشْعَثُ بْنُ قَيْسٍ ، فَقَالَ : مَا حَدَّثَكُمْ أَبُو عَبْدِ الرَّحْمَنِ ، فَقَالُوا : كَذَا وَكَذَا ، قَالَ : فِيَّ أُنْزِلَتْ ، كَانَتْ لِي بِئْرٌ فِي أَرْضِ ابْنِ عَمٍّ لِي ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " بَيِّنَتُكَ أَوْ يَمِينُهُ " ، قُلْتُ : إِذًا يَحْلِفُ عَلَيْهَا يَا رَسُولَ اللَّهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ حَلَفَ عَلَى يَمِينِ صَبْرٍ وَهُوَ فِيهَا فَاجِرٌ ، يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ ، لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ " .
(The sub-narrator added:) Al-Ash'ath bin Qais entered, saying, "What did Abu `Abdur-Rahman narrate to you?" They said, "So-and-so," Al-Ash'ath said, "This verse was revealed in my connection. I had a well on the land of my cousin (and we had a dispute about it). I reported him to Allah 's Apostle who said (to me). "You should give evidence (i.e. witness) otherwise the oath of your opponent will render your claim invalid." I said, "Then he (my opponent) will take the oath, O Allah's Apostle." Allah's Apostle said, "Whoever is ordered (by the ruler or the judge) to give an oath, and he takes a false oath in order to grab the property of a Muslim, then he will incur Allah's Wrath when he meets Him on the Day of Resurrection."

Hadith Commentary:
In another hadith, the context of revelation (shan-e-nuzul) of the mentioned verse is described as follows, the details of which are narrated by Abdullah ibn Abi Awfa radi Allahu anhu: A man placed his goods in the market and, in order to entrap a Muslim, swore a false oath, saying, "I used to get such-and-such a price for this merchandise," whereas this statement was false. Then Allah, the Exalted, revealed this verse.

It is possible that this verse was revealed on both occasions, because its wording is general and encompasses both situations.
It is also possible that this verse had already been revealed, but Abdullah ibn Abi Awfa radi Allahu anhu became aware of it after the mentioned incident, and thus he thought that this verse was revealed concerning that particular event.

In any case, the matter of the rights of people (huquq al-‘ibad) is extremely serious and sensitive; a person should exercise caution in this regard.
