Hadith 5979

Narrated Asma': "My mother who was a Mushrikah (pagan, etc.), came with her father during the period of peace pact between the Muslims and the Quraish infidels. I went to seek the advice of the Prophet (saws) saying, "My mother has arrived and she is hoping (for my favor)." The Prophet (saws) said, "Yes, be good to your mother."

Hadith Commentary:
Hazrat Asma was a married woman; she had already been married to Hazrat Zubair radi Allahu anhu. Accordingly, Hafiz Ibn Hajar rahimahullah writes that the Messenger of Allah sallallahu alayhi wa sallam granted Hazrat Asma radi Allahu anha permission to maintain ties of kinship with her mother, and in this matter, he did not instruct her to consult her husband. (Fath al-Bari: 10/508) Therefore, in the matter of maintaining ties of kinship with her mother, there is no need for a woman to consult her husband; she should maintain ties of kinship with her mother. Even after marriage, this remains her obligation and the mother’s right to service does not end. However, in the case of a conflict of rights, the husband’s right will take precedence. And Allah knows best.
