Hadith 5582

حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَبْدِ اللَّهِ ، قَالَ : حَدَّثَنِي مَالِكُ بْنُ أَنَسٍ ، عَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ ، عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " كُنْتُ أَسْقِي أَبَا عُبَيْدَةَ ، وَأَبَا طَلْحَةَ ، وَأُبَيَّ بْنَ كَعْبٍ ، مِنْ فَضِيخِ زَهْوٍ وَتَمْرٍ ، فَجَاءَهُمْ آتٍ ، فَقَالَ : إِنَّ الْخَمْرَ قَدْ حُرِّمَتْ ، فَقَالَ أَبُو طَلْحَةَ : قُمْ يَا أَنَسُ فَأَهْرِقْهَا ، فَأَهْرَقْتُهَا " .
Narrated Anas bin Malik: I was serving Abu 'Ubaida, Abu Talha and Ubai bin Ka`b with a drink prepared from ripe and unripe dates. Then somebody came to them and said, "Alcoholic drinks have been prohibited." (On hearing that) Abu Talha said, "Get up. O Anas, and pour (throw) it out! So I poured (threw) it out.

Hadith Commentary: In compliance with the command, the state of Madinah was such that wine was flowing through the streets of Madinah like rainwater. Al-Qurtubi said: “The ahadith narrated from Anas radi Allahu anhu and others, due to their authenticity and abundance, invalidate the view of the Kufans who claim that ‘khamr’ (wine) is only that which is extracted from grapes, and that which is made from other substances is not called ‘khamr’ and does not fall under the name of ‘khamr’. This view is contrary to the language of the Arabs, to the authentic Sunnah, and to the Companions radi Allahu anhum.” (Fath al-Bari)

That is, Qurtubi said that the authentic narrations transmitted from Anas radi Allahu anhu and others invalidate the school of the Kufans, who say that ‘khamr’ refers only to wine distilled from grapes, and that which is prepared from other things is not ‘khamr’. The statement of the people of Kufa is contrary to the Arabic language, the authentic Sunnah, and the Companions radi Allahu anhum.
