Hadith 5290

حَدَّثَنَا قُتَيْبَةُ ، حَدَّثَنَا اللَّيْثُ ، عَنْ نَافِعٍ ، أَنَّ ابْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا كَانَ يَقُولُ فِي الْإِيلَاءِ الَّذِي سَمَّى اللَّهُ : " لَا يَحِلُّ لِأَحَدٍ بَعْدَ الْأَجَلِ إِلَّا أَنْ يُمْسِكَ بِالْمَعْرُوفِ أَوْ يَعْزِمَ بِالطَّلَاقِ كَمَا أَمَرَ اللَّهُ عَزَّ وَجَلَّ " . وقَالَ لِي إِسْمَاعِيلُ : حَدَّثَنِي مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ ابْنِ عُمَرَ ، " إِذَا مَضَتْ أَرْبَعَةُ أَشْهُرٍ يُوقَفُ حَتَّى يُطَلِّقَ وَلَا يَقَعُ عَلَيْهِ الطَّلَاقُ حَتَّى يُطَلِّقَ " ، وَيُذْكَرُ ذَلِكَ عَنْ عُثْمَانَ ، وعَلِيٍّ ، وأَبِي الدَّرْدَاءِ ، وعَائِشَةَ ، واثْنَيْ عَشَرَ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
Narrated Nafi`: Ibn `Umar used to say about the Ila (which Allah defined (in the Holy Book), "If the period of Ila expires, then the husband has either to retain his wife in a handsome manner or to divorce her as Allah has ordered."

Hadith Commentary:

The Hanafis say that if the period of four months passes and the man does not reconcile, then an irrevocable divorce (talaq bain) will automatically take effect. However, this statement of the Hanafis is not correct. For details, see Sharh Wahidi.

Hadith Commentary:
(1)
When the period for the one who has taken an oath of abstinence (ila’) is completed, he has two options before him:
٭ He may resume relations with his wife and keep her with him in a recognized (ma‘ruf) manner.
٭ Or he may divorce his wife and release her from his marriage.

(2)
After four months, he should reconcile, that is, have marital relations with her.
If a person is unable to have intercourse due to his own illness, the wife’s illness, or any other reason, then he should reconcile verbally.
