Hadith 5277

وَقَوْلِهِ تَعَالَى : وَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا إِلَى قَوْلِهِ : خَبِيرًا سورة النساء آية 35 .
And Allah has said (in Surah An-Nisa) «وإن خفتم شقاق بينهما فابعثوا حكما من أهله وحكما من أهلها» "If you fear dissension between the two (husband and wife), appoint an arbitrator from his people and an arbitrator from her people." (to the end of the verse).
حَدَّثَنَا سُلَيْمَانُ ، حَدَّثَنَا حَمَّادٌ ، عَنْ أَيُّوبَ ، عَنْ عِكْرِمَةَ ، أَنَّ جَمِيلَةَ ، فَذَكَرَ الْحَدِيثَ .
Narrated `Ikrima: that Jamila... Then he related the whole ,Hadith, (i.e. 199).

Hadith Commentary:

Imam Bukhari rahimahullah has indicated in this hadith that the woman who sought khul‘ from Thabit bin Qais radi Allahu anhu was named Jameelah.
Some narrations indicate that the woman who sought khul‘ was Zaynab, the daughter of Abdullah bin Ubayy.
In one narration of Sunan Ibn Majah, her name is mentioned as Maryam Maghaliyyah.
(Sunan Ibn Majah, al-Talaq, Hadith: 2058)
According to one narration in Sahih Bukhari, she was the sister of Abdullah bin Ubayy.
(Sahih al-Bukhari, al-Talaq, Hadith: 5274)
In most narrations, her name is given as Habibah bint Sahal.
(Sunan Abi Dawud, al-Talaq, Hadith: 2227; Sunan al-Nasa’i, al-Talaq, Hadith: 3493; al-Muwatta’: 2/564)

From these various narrations, it is understood that Thabit bin Qais radi Allahu anhu married several women, and they separated from him through khul‘.
