Hadith Commentary:
(1)
This refers to Ma'iz bin Malik al-Aslami radi Allahu anhu, who presented himself and was willing to give up his life, but did not prefer the punishment of the Hereafter. In one narration, when the Messenger of Allah sallallahu alayhi wa sallam heard that he had run away, he said:
"Why did you not leave him? Perhaps he would have repented and Allah, the Exalted, would have forgiven his sin." (Sunan Abi Dawud, Hudud, Hadith: 4419)
(2)
According to these ahadith, the Messenger of Allah sallallahu alayhi wa sallam asked Ma'iz radi Allahu anhu:
"Do you have madness?" Imam Bukhari rahimahullah established the chapter heading with these words, that if he had been insane, his confession would not have been valid.
When in hudud (prescribed punishments) his confession is not valid, then in divorce (talaq) as well it will not be considered valid, because sanity is a fundamental condition in divorce.
And Allah knows best.
