Hadith 5098

لِقَوْلِهِ تَعَالَى : مَثْنَى وَثُلاثَ وَرُبَاعَ سورة النساء آية 3 ، وَقَالَ عَلِيُّ بْنُ الْحُسَيْنِ عَلَيْهِمَا السَّلَام : يَعْنِي مَثْنَى أَوْ ثُلَاثَ أَوْ رُبَاعَ ، وَقَوْلُهُ جَلَّ ذِكْرُهُ : أُولِي أَجْنِحَةٍ مَثْنَى وَثُلاثَ وَرُبَاعَ سورة فاطر آية 1 يَعْنِي مَثْنَى أَوْ ثُلَاثَ أَوْ رُبَاعَ .
Because Allah the Exalted has said «مثنى وثلاث ورباع» and the "waaw" is in the meaning of "or" «أو» (that is, marry two wives, or three, or four). Zain al-Abidin ibn Husayn, peace be upon him, says: it means two, or three, or four, just as there is a similar example in Surah Fatir «أولي أجنحة مثنى وثلاث ورباع» meaning "angels with two wings, or three, or four wings."
حَدَّثَنَا مُحَمَّدٌ ، أَخْبَرَنَا عَبْدَةُ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، " وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى سورة النساء آية 3 ، قَالَتْ :الْيَتِيمَةُ تَكُونُ عِنْدَ الرَّجُلِ وَهُوَ وَلِيُّهَا فَيَتَزَوَّجُهَا عَلَى مَالِهَا ، وَيُسِيءُ صُحْبَتَهَا ، وَلَا يَعْدِلُ فِي مَالِهَا ، فَلْيَتَزَوَّجْ مَا طَابَ لَهُ مِنَ النِّسَاءِ سِوَاهَا مَثْنَى وَثُلَاثَ وَرُبَاعَ " .
Narrated Aisha": (regarding) the Verse: 'And if you fear that you shall not be able to deal justly with the orphans...' (4.3) It is about the orphan girl who is in the custody of a man who is her guardian, and he intends to marry her because of her wealth, but he treats her badly and does not manage her property fairly and honestly. Such a man should marry women of his liking other than her, two or three or four. 'Prohibited to you (for marriage) are: ...your foster-mothers (who suckled you).' (4.23) Marriage is prohibited between persons having a foster suckling relationship corresponding to a blood relationship which renders marriage unlawful.

Hadith Commentary:
In Islamic Sharia, it is absolutely forbidden to have more than four wives at the same time.
In this chapter, Imam Bukhari rahimahullah has cited the statement of Zayn al-Abidin rahimahullah to refute the Rafidah, because they hold him in great esteem, so how can they then consider it permissible to interpret the Noble Qur’an contrary to his statement?

In Islamic Shariah, it is forbidden to have more than four wives at the same time.
The permission for four is also conditional upon justice and fairness, as is evident from the context of the aforementioned hadith.
This is clarified in other ahadith:
➊ When Hazrat Ghailan radi Allahu anhu accepted Islam, he had ten wives.
The Messenger of Allah sallallahu alayhi wa sallam said:
“Select four of them and separate yourself from the rest of the women.”
(Sunan Ibn Majah, Al-Nikah, Hadith: 1953)
➋ Hazrat Qais bin Harith radi Allahu anhu says:
When I accepted Islam, I had eight wives.
The Messenger of Allah sallallahu alayhi wa sallam said:
“Choose four of them.”
(Sunan Abi Dawud, Al-Talaq, Hadith: 2241)
➌ When Nawfal bin Muawiyah radi Allahu anhu accepted Islam, he had five wives.
The Messenger of Allah sallallahu alayhi wa sallam said to him:
“Keep four and leave the other, that is, the fifth one.”

Hafiz Ibn Hajar rahimahullah has written regarding the aforementioned ruling that it is established by consensus (ijma‘).
