Hadith 5064

حَدَّثَنَا عَلِيٌّ ، سَمِعَ حَسَّانَ بْنَ إِبْرَاهِيمَ ، عَنْ يُونُسَ بْنِ يَزِيدَ ، عَنْ الزُّهْرِيِّ ، قَالَ : أَخْبَرَنِي عُرْوَةُ ، أَنَّهُ سَأَلَ عَائِشَةَ ، عَنْ قَوْلِهِ تَعَالَى :وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ مَثْنَى وَثُلاثَ وَرُبَاعَ فَإِنْ خِفْتُمْ أَلَّا تَعْدِلُوا فَوَاحِدَةً أَوْ مَا مَلَكَتْ أَيْمَانُكُمْ ذَلِكَ أَدْنَى أَلَّا تَعُولُوا سورة النساء آية 3 ، قَالَتْ : " يَا ابْنَ أُخْتِي ، الْيَتِيمَةُ تَكُونُ فِي حَجْرِ وَلِيِّهَا فَيَرْغَبُ فِي مَالِهَا وَجَمَالِهَا ، يُرِيدُ أَنْ يَتَزَوَّجَهَا بِأَدْنَى مِنْ سُنَّةِ صَدَاقِهَا ، فَنُهُوا أَنْ يَنْكِحُوهُنَّ إِلَّا أَنْ يُقْسِطُوا لَهُنَّ فَيُكْمِلُوا الصَّدَاقَ ، وَأُمِرُوا بِنِكَاحِ مَنْ سِوَاهُنَّ مِنَ النِّسَاءِ " .
Narrated 'Urwa: that he asked `Aisha about the Statement of Allah: 'If you fear that you shall not be able to deal justly with the orphan girls, then marry (other) women of your choice, two or three or four; but if you fear that you shall not be able to deal justly (with them), then only one, or (the captives) that your right hands possess. That will be nearer to prevent you from doing injustice.' (4.3) `Aisha said, "O my nephew! (This Verse has been revealed in connection with) an orphan girl under the guardianship of her guardian who is attracted by her wealth and beauty and intends to marry her with a Mahr less than what other women of her standard deserve. So they (such guardians) have been forbidden to marry them unless they do justice to them and give them their full Mahr, and they are ordered to marry other women instead of them."

Hadith Commentary:
That is, in this verse where it is stated, "If you fear that you will not deal justly with the orphan girls, then marry those women who please you," so ‘Urwah inquired about its meaning: what does it mean to not deal justly with the orphan girls, and what is the connection between the conditional clause "If you fear" (wa in khiftum) and the statement "then marry those women who please you" (fa-nkihu ma taba lakum min an-nisa’) (al-Nisa: 3)? This verse is in Surah al-Nisa, and this hadith has already been mentioned in the commentary of this surah.
In response to ‘Urwah, ‘A’ishah radi Allahu anha gave the explanation that is mentioned in the hadith.

Hadith Commentary:
(1)
This hadith encourages contracting marriage with the intention of giving the full dowry (mahr), because through this, chastity is preserved, lineage is guaranteed, and intercession from the newborn is expected. Thus, it is mentioned in the hadith that even a stillborn child will intercede for his parents in the presence of Allah, the Exalted.

In any case, marriage outwardly appears to be a worldly matter, but when one reflects upon its religious benefits and objectives, it is related to religious affairs and acts of worship. In a hadith it is stated:
“Marry women who are loving and prolific, for I will boast of your great numbers before the other nations on the Day of Resurrection.” (Musnad Ahmad: 245/3)
In this hadith, the imperative form is present, whose lowest degree is recommendation (istihbab), and if there is a fear of falling into fornication due to overwhelming desire, then marriage becomes obligatory (wajib).
