Hadith 4764

حَدَّثَنَا آدَمُ ، حَدَّثَنَا شُعْبَةُ ، حَدَّثَنَا مَنْصُورٌ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، قَالَ : " سَأَلْتُ ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، عَنْ قَوْلِهِ تَعَالَى : فَجَزَاؤُهُ جَهَنَّمُ سورة النساء آية 93 ، قَالَ : لَا تَوْبَةَ لَهُ ، وَعَنْ قَوْلِهِ جَلَّ ذِكْرُهُ : لا يَدْعُونَ مَعَ اللَّهِ إِلَهًا آخَرَ سورة الفرقان آية 68 ، قَالَ : كَانَتْ هَذِهِ فِي الْجَاهِلِيَّةِ " .
Narrated Sa`id bin Jubair: I asked Ibn `Abbas about Allah's saying:-- '.. this reward is Hell Fire.' (4.93) He said, "No repentance is accepted from him (i.e. the murderer of a believer)." I asked him regarding the saying of Allah: 'Those who invoke not with Allah any other god.' ...(25.68) He said, "This Verse was revealed concerning the pagans of the pre-lslamic period."

Hadith Commentary:
That is, those people who committed murder during the time of ignorance and then embraced Islam—their ruling has been explained in this verse. However, if a Muslim unjustly kills his Muslim brother, then according to Ibn Abbas (radi Allahu anhuma), his punishment is Hellfire.
Repentance for this sin is not accepted from him.
This is the very fatwa of Ibn Abbas (radi Allahu anhuma): whoever deliberately and unjustly kills a Muslim is eternally destined for Hellfire.
However, the majority of the Ummah holds the opinion that such a sinner, if he pays blood money (diyah) to the heirs of the murdered and repents, then he becomes eligible for forgiveness.
Perhaps the fatwa of Ibn Abbas (radi Allahu anhuma) was given as a form of stern warning and rebuke.
In any case, the fatwa of the majority is closer to the mercy of Allah.

Hadith Commentary:
The opinion of Ibn Abbas radi Allahu anhu was that the repentance mentioned in Surah Al-Furqan:
﴿إِلَّا مَنْ تَابَ وَآمَنَ وَعَمِلَ عَمَلًا صَالِحًا﴾
refers not to those Muslims who deliberately shed the blood of a believer, but rather, this verse pertains only to the acceptance of faith by disbelievers and polytheists.

This is the personal legal verdict (fatwa) of Ibn Abbas radi Allahu anhu, but other scholars have indicated the possibility of repentance and seeking forgiveness for such a murderer, the evidences for which we have presented in the benefits of Sahih al-Bukhari, Hadith: 4590.
