حَدَّثَنَا

هِشَامٍ ، قَالَ : أَخْبَرَنِي
أَبِي ، عَنْ
عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا : أَنَّ أَبَاهَا كَانَ لَا يَحْنَثُ فِي يَمِينٍ ، حَتَّى أَنْزَلَ اللَّهُ كَفَّارَةَ الْيَمِينِ ، قَالَ أَبُو بَكْرٍ : " لَا أَرَى يَمِينًا أُرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا قَبِلْتُ رُخْصَةَ اللَّهِ وَفَعَلْتُ الَّذِي هُوَ خَيْرٌ " .
Narrated Aisha: That her father (Abu Bakr) never broke his oath till Allah revealed the order of the legal expiation for oath. Abu Bakr said, "If I ever take an oath (to do something) and later find that to do something else is better, then I accept Allah's permission and do that which is better, (and do the legal expiation for my oath ) ".

Hadith Commentary:
Tha'labi said that the verse: "Allah will not call you to account for what is unintentional in your oaths" (: al-Ma'idah: 89) was revealed concerning Abu Bakr (radi Allahu anhu). When he became angry, he swore an oath that from then on he would not show any kindness to Mistah ibn Uthathah (radi Allahu anhu). This Mistah (radi Allahu anhu) had participated in the accusation against Aisha (radi Allahu anha).

Taking an oath regarding doing or not doing something in the future is a binding oath (yamin mun'aqidah), for the breaking of which expiation (kaffarah) must be given.
The statement of Allah, the Exalted, is:
"The expiation for an oath is to feed ten needy people with food of the average quality with which you feed your own families, or to clothe them, or to free a slave. But whoever cannot find (the means) should fast for three days. That is the expiation for your oaths when you have sworn and then broken them." ( al-Ma'idah: 89/5)

In this regard, the Messenger of Allah (sallallahu alayhi wa sallam) said:
"If you swear an oath to do something, then you see that something else is better, then offer expiation for your oath and do that which is better."
