Hadith 4601

وَقَالَ ابْنُ عَبَّاسٍ : شِقَاقٌ : تَفَاسُدٌ ، وَأُحْضِرَتِ الْأَنْفُسُ الشُّحَّ : هَوَاهُ فِي الشَّيْءِ يَحْرِصُ عَلَيْهِ كَالْمُعَلَّقَةِ ، لَا هِيَ أَيِّمٌ ، وَلَا ذَاتُ زَوْجٍ نُشُوزًا بُغْضًا .
Ibn Abbas (may Allah be pleased with them both) said that in (the Ayah) «شقاق» means corruption and discord. «وأحضرت الأنفس الشح» means every soul is greedy for its own benefit. «كالمعلقة» means that she is neither a widow nor a married woman. «نشوزا» means «بغضا» in the sense of enmity.
حَدَّثَنَا مُحَمَّدُ بْنُ مُقَاتِلٍ ، أَخْبَرَنَا عَبْدُ اللَّهِ ، أَخْبَرَنَا هِشَامُ بْنُ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا : وَإِنِ امْرَأَةٌ خَافَتْ مِنْ بَعْلِهَا نُشُوزًا أَوْ إِعْرَاضًا سورة النساء آية 128 ، قَالَتْ : " الرَّجُلُ تَكُونُ عِنْدَهُ الْمَرْأَةُ لَيْسَ بِمُسْتَكْثِرٍ مِنْهَا ، يُرِيدُ أَنْ يُفَارِقَهَا ، فَتَقُولُ : أَجْعَلُكَ مِنْ شَأْنِي فِي حِلٍّ ، فَنَزَلَتْ هَذِهِ الْآيَةُ فِي ذَلِكَ " .
Narrated `Aisha: Regarding the Verse:--"If a woman fears cruelty or desertion on her husband's part." (4.128) It is about a man who has a woman (wife) and he does not like her and wants to divorce her but she says to him, "I make you free as regards myself." So this Verse was revealed in this connection.

If a wife and husband come to a mutual agreement and settle on something, there is no objection in this.
For example, if the wife waives her turn or some other matter is agreed upon.

Hadith Commentary:

The practical interpretation of this verse is illustrated by the following incident.
Ibn Abbas (radi Allahu anhu) narrates:
When Sawdah (radi Allahu anha) sensed that the Messenger of Allah (sallallahu alayhi wa sallam) intended to divorce her, she said to him:
“O Messenger of Allah (sallallahu alayhi wa sallam)! Do not divorce me, but rather keep me with you, and I will give my turn to Aishah (radi Allahu anha).” Thus, the Messenger of Allah (sallallahu alayhi wa sallam) did as she requested.
At that time, this verse was revealed.
Thus, whatever condition the husband and wife agree upon for reconciliation is permissible.

In any case, if the wife relinquishes her turn and other rights, then those rights of hers will be forfeited. Accordingly, in another narration, it is further clarified that when a woman observes her husband’s aversion, she says:
“Keep me with you and do not divorce me; you may marry someone else as well. You are absolved of my maintenance, and on my turn, you do not need to spend the night with me.”

Despite this, the husband should never let go of justice and fairness under any circumstances.
