Hadith 3658

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، أَخْبَرَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ أَيُّوبَ ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي مُلَيْكَةَ ، قَالَ : كَتَبَ أَهْلُ الْكُوفَةِ إِلَى ابْنِ الزُّبَيْرِ فِي الْجَدِّ ، فَقَالَ : أَمَّا الَّذِي ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَوْ كُنْتُ مُتَّخِذًا مِنْ هَذِهِ الْأُمَّةِ خَلِيلًا لَاتَّخَذْتُهُ أَنْزَلَهُ أَبًا يَعْنِي أَبَا بَكْرٍ " .
Narrated `Abdullah bin Abi Mulaika: The people of Kufa sent a letter to Ibn Az-Zubair, asking about (the inheritance of) (paternal) grandfather. He replied that the right of the inheritance of (paternal) grandfather is the same as that of father if the father is dead) and added, "Allah's Apostle said, ' If I were to take a Khalil from this nation, I would have taken him (i.e. Abu Bakr).

Hadith Commentary:

Abu Bakr (radi Allahu anhu) considered the grandfather to be in the position of the father regarding entitlement to inheritance; that is, if a person passes away and his grandfather is alive, then in the absence of the father, the grandfather will be entitled to his grandson’s inheritance.

Imam Bukhari (rahimahullah) has presented this hadith for the purpose that in it is the noble statement of the Messenger of Allah (sallallahu alayhi wa sallam):
“If I were to take anyone from my ummah as a close friend (khalil), I would have taken Abu Bakr, but my khalil is only Allah, the Exalted.”
