Narrated Jubair bin Mut`im: `Uthman bin `Affan went (to the Prophet) and said, "O Allah's Apostle! You gave property to Bani Al-Muttalib and did not give us, although we and they are of the same degree of relationship to you." The Prophet said, "Only Bani Hashim and Bani Al Muttalib are one thing (as regards family status).

Hadith Commentary:
1.
The Messenger of Allah (sallallahu alayhi wa sallam) used to give the share of his kin from the spoils (khums) only to Banu Hashim and Banu Muttalib, and would not give anything from it to Banu Abd Shams and Banu Nawfal, as is explicitly stated in a hadith.
(Sahih al-Bukhari, Kitab al-Fard al-Khums, Hadith: 3140)
Although Abd Shams, Hashim, and Muttalib were all full brothers and their mother was Atikah bint Murrah, Nawfal’s mother was different, and he was only their brother from the father’s side.

The Messenger of Allah (sallallahu alayhi wa sallam) said:
“Banu Hashim and Banu Muttalib have always been as one thing in the time of Jahiliyyah and in Islam, whereas Banu Nawfal and Banu Abd Shams separated from them, so they are not entitled to the share of kinship.”

Imam al-Bukhari (rahimahullah) has established a chapter heading on this hadith:
“The distribution of khums is at the discretion of the Imam; he may give it to whomever he wishes and withhold it from whomever he wishes, because the Messenger of Allah (sallallahu alayhi wa sallam) gave the khums of Khaybar only to Banu Hashim and Banu Muttalib.”
