Hadith 3362

حَدَّثَنِي أَحْمَدُ بْنُ سَعِيدٍ أَبُو عَبْدِ اللَّهِ ، حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ ، عَنْ أَبِيهِ ، عَنْ أَيُّوبَ ، عَنْ عَبْدِ اللَّهِ بْنِ سَعِيدِ بْنِ جُبَيْرٍ ، عَنْ أَبِيهِ ، عَنْ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " يَرْحَمُ اللَّهُ أُمَّ إِسْمَاعِيلَ لَوْلَا أَنَّهَا عَجِلَتْ لَكَانَ زَمْزَمُ عَيْنًا مَعِينًا " .
Narrated Ibn `Abbas: The Prophet said, "May Allah bestow His Mercy on the mother of Ishmael! Had she not hastened (to fill her water-skin with water from the Zamzam well). Zamzam would have been a stream flowing on the surface of the earth."

Hadith Commentary:
In this hadith, there is an allusion to those incidents involving Hajar (radi Allahu anha) when she first settled in the sacred city of Makkah. At that time, Ibrahim (alayhis salam) had entrusted her to Allah and departed, and she was circling between the hills of Safa and Marwah in search of water. Suddenly, she saw the spring of Zamzam. She ran to it and began to build a barrier around its water. This very situation is being described here.

The absolute mujtahid (independent jurist) has brought this hadith here to explain the legal issue that if the original owner of a well or pond is present, then in any case, the right of ownership is established for him. The chapter heading is derived from the statement of Hajar (radi Allahu anha) that “there will be no right for you (the tribe of Jurhum) over the water,” and the Prophet (sallallahu alayhi wa sallam) did not object to this.

Khatabi said that from this it is derived that whoever brings forth water in the wilderness becomes its owner, and no one else can share in it without his consent.

Hajar (radi Allahu anha) was the daughter of a Pharaoh of Egypt. Having witnessed the miracles of Ibrahim (alayhis salam) and his wife Sarah (radi Allahu anha), she considered it an honor to join this blessed family and was thus given to them. Although the water of Zamzam was caused to gush forth by the strike of Jibril (alayhis salam), nevertheless, it belonged to Umm Isma'il herself.
Umm Isma'il said to the people of the Jurhum tribe:
"You may camp here, but you will have no claim over the water."
Since those people fully understood the importance of the matter, they acknowledged the right of Umm Isma'il.

Allamah Khattabi (rahimahullah) has said that if someone digs a well in the wilderness and brings forth water, then he becomes its owner, and no one else may share in that well without his consent.
