Hadith 2765

حَدَّثَنَا عُبَيْدُ بْنُ إِسْمَاعِيلَ ، حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا وَمَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ سورة النساء آية 6 ، قَالَتْ : أُنْزِلَتْ فِي وَالِي الْيَتِيمِ أن يصيب من ماله ، إذا كان محتاجا بقدر ماله بالمعروف " .
Narrated `Aisha: The following Verse:-- "If a guardian is well-off, let him claim no remuneration (i.e. wages), but if he is poor, let him have for himself what is just and reasonable." (4.6) was revealed in connection with the guardian of an orphan, and it means that if he is poor he can have for himself (from the orphan's wealth) what is just and reasonable according to the orphan's share of the inheritance.

From this hadith, the first part of the chapter is established, that is, engaging in trade with the wealth of orphans with good intention, and then consuming from it according to one's effort is permissible.

Hadith Commentary:

The gist of this narration is that it is permissible to invest the wealth of an orphan in trade, and effort should be made in this regard. If the guardian of the orphan is wealthy, then he should perform this service for the sake of Allah (fi sabilillah). If he is in need, then he is permitted to take according to his necessity or in proportion to his work.
(2)
In matters other than those concerning orphans, if a person is occupied (i.e., engaged in some work or service), he may take compensation according to his work and effort, whether the one exerting effort is wealthy or needy. However, with the wealth of orphans, great caution is necessary because there is an explicit text regarding this caution. And Allah knows best.
