Hadith 2743

وَقَالَ الْحَسَنُ : لَا يَجُوزُ لِلذِّمِّيِّ وَصِيَّةٌ ، إِلَّا الثُّلُثَ ، وَقَالَ اللَّهُ تَعَالَى : وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ سورة المائدة آية 49 .
And Imam Hasan al-Basri (may Allah have mercy on him) said that a bequest of more than one-third of the wealth will not be executed even for a dhimmi disbeliever. Allah the Exalted said in Surah al-Ma'idah «وأن احكم بينهم بما أنزل الله‏»: "Judge between them (even among non-Muslims) according to what Allah has revealed to you."
حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ ، حَدَّثَنَا سُفْيَانُ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، قَالَ : " لَوْ غَضَّ النَّاسُ إِلَى الرُّبْعِ لِأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : الثُّلُثُ وَالثُّلُثُ كَثِيرٌ أَوْ كَبِيرٌ " .
Narrated Ibn `Abbas: I recommend that people reduce the proportion of what they bequeath by will to the fourth (of the whole legacy), for Allah's Apostle said, "One-third, yet even one third is too much."

Hadith Commentary: Benefits and Issues: Statements from some Companions (radi Allahu anhum) and Followers (tabi‘in) have been transmitted regarding making it less than a quarter. The fundamental principle is that the person making the bequest should consider the amount of his estate, the number of his heirs, and their needs, and thus make it less than a third. However, during his lifetime, he may spend as much as he wishes in the way of Allah (fi sabilillah) or on righteous deeds; there is no restriction upon this.

Benefit:
In this hadith, the limit of bequest (wasiyyah) has been specified: it is permissible to make a bequest for up to one third of one’s wealth; making a bequest for more than this is not allowed. Unfortunately, some people, out of anger or excessive love for someone, make a bequest for their entire wealth—this is a sin, and it is not effective. If a person makes such a bequest, it will not be acted upon.
