Hadith 2734

وَقَالَ ابْنُ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، وَعَطَاءٌ : إِذَا أَجَّلَهُ فِي الْقَرْضِ جَازَ .
'And Abdullah bin Umar and Ata bin Abi Rabah, may Allah be pleased with them, said: If a term is fixed for the repayment of a debt, then it is permissible.'
وَقَالَ اللَّيْثُ حَدَّثَنِي جَعْفَرُ بْنُ رَبِيعَةَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ هُرْمُزَ عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ ذَكَرَ رَجُلاً سَأَلَ بَعْضَ بَنِي إِسْرَائِيلَ أَنْ يُسْلِفَهُ أَلْفَ دِينَارِ، فَدَفَعَهَا إِلَيْهِ إِلَى أَجَلٍ مُسَمًّى.
Narrated Abu Huraira: Allah's Apostle mentioned a person who asked an Israeli man to lend him one-thousand Dinars, and the Israeli lent him the sum for a certain fixed period.

Hadith Commentary:
It is understood from this that the lender may stipulate such permissible conditions, and it will be obligatory upon the one who is to repay the loan that he fulfills the repayment at the appointed time under those very conditions.
The mention of those two men from Bani Isra'il has already been discussed in detail previously.

Some individuals are of the opinion that when giving a loan, one should not stipulate a fixed period for repayment. Imam Bukhari rahimahullah does not agree with this position. In his view, it is permissible to fix a period. Previously, in the Book of Sales (Kitab al-Buyu‘), he established a chapter with these words:
(Chapter: If he lends him for a specified term or delays payment in a sale for a term)
“When someone gives a loan for a fixed period or sells on credit for a fixed period.” (Sahih al-Bukhari, al-Istiqrad, before Hadith: 2404)
There too, he presented the reports (athar) of Ibn ‘Umar radi Allahu anhu and ‘Ata’ rahimahullah, and also referenced the aforementioned hadith. In any case, by equating loan and deferred payment there, he indicated his inclination.

According to the hadiths, Imam Bukhari rahimahullah’s position is strengthened that the lender may stipulate such permissible conditions, and it is obligatory upon the borrower to repay the loan at the appointed time according to those conditions. The incident of the two men from Bani Isra’il has already been mentioned.
