Hadith 2474

وَقَالَ عُبَادَةُ : بَايَعْنَا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ لَا نَنْتَهِبَ .
'And ‘Ubada (may Allah be pleased with him) said, "We pledged allegiance to the Prophet (peace and blessings be upon him) that we would not commit looting."'
حَدَّثَنَا آدَمُ بْنُ أَبِي إِيَاسٍ ، حَدَّثَنَا شُعْبَةُ ، حَدَّثَنَا عَدِيُّ بْنُ ثَابِتٍ ، سَمِعْتُ عَبْدَ اللَّهِ بْنَ يَزِيدَ الْأَنْصَارِيَّ وَهُوَ جَدُّهُ أَبُو أُمِّهِ ، قَالَ : " نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ النُّهْبَى وَالْمُثْلَةِ " .
Narrated `Abdullah bin Yazid Al-Ansari: The Prophet forbade robbery (taking away what belongs to others without their permission), and also forbade mutilation (or maiming) of bodies.

Hadith Commentary:
Looting, highway robbery, and theft have been strongly condemned in Islam, and the harshest punishments have been prescribed for them, such that the hands and feet of the thief are to be cut off. Even more severe punishments have been prescribed for bandits and highwaymen.
This is so that humanity may live a life of peace and security.
It is due to the blessings of these laws that even today the security of the government of Saudi Arabia stands as an exemplary model for all the governments of the world, whereas among all so-called civilized people, banditry in various forms is increasing day by day.
Theft is becoming established as a profession.
The lives of the public are being spent in extreme fear.
The army and police are all helpless before such criminals.
This is because, in their systems, legal leniency greatly encourages them.
Muthlah: In war, to cut off the hands, feet, or ears of the slain and separate them.
Islam has strictly prohibited this act.

Some individuals have derived from the chapter heading established by Imam Bukhari rahimahullah the ruling that the scrambling for dates (chuhaare) at the time of marriage is permissible, whereas such behavior is contrary to human dignity, and in the religion of Islam, dignity also holds a certain status. In support of its permissibility, a narration is also presented that the Messenger of Allah sallallahu alayhi wa sallam forbade looting in military expeditions but permitted it on occasions of marriage. Regarding its chain of transmission, Imam Bayhaqi rahimahullah has stated that in its chain, there are two narrators, ‘Awn and ‘Ismah, who are unreliable. (Umdat al-Qari: 237/9) On this basis, this hadith is not suitable as evidence. If, on the occasion of marriage, dates, almonds, candies, etc. are to be distributed, they should be distributed in a dignified manner; however, to consider this as a Sunnah is questionable.

At the time of war or battle, mutilating the appearance of the slain is called "muthlah," such as cutting off their ears, nose, etc. The Messenger of Allah sallallahu alayhi wa sallam forbade such treatment even towards disbelieving enemies; however, mutilation is permissible in retribution (qisas).

Hadith Commentary:
These sentences of the hadith are clear evidence of Islam’s pure guidance regarding mercy and kindness. Those who act contrary to these are considered accursed in the sight of Islam. The opponents who deny the mercy and kindness of Islam should reflect upon such pure teachings.

There is a clear instruction: “Irhamu man fil ard, yarhamkum man fis samaa’” — O people! Show mercy to those on the earth, and the One in the heavens will show mercy to you. Truly:

Show kindness to the people of the earth,
And God, the Most Merciful, will be kind to you from the Throne above.

Hadith Commentary:
All these ahadith instruct to show mercy and kindness to the creation of Allah Almighty.
Those who act contrary to this are accursed in Islam and among the people of Islam.
Those opponents of Islam who claim that Islam teaches terrorism must reflect upon themselves; Islam absolutely does not permit that even an animal be troubled without reason, let alone that the noblest of creation, the human being, be cut down without cause like a carrot or a radish.
And Allah is the One whose help is sought.
