Hadith 2462

وَجَلَسَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَصْحَابُهُ فِي سَقِيفَةِ بَنِي سَاعِدَةَ .
And the Prophet (ﷺ) was sitting with his companions in the courtyards of Banu Sa'idah.
حَدَّثَنَا يَحْيَى بْنُ سُلَيْمَانَ ، قَالَ : حَدَّثَنِي ابْنُ وَهْبٍ ، قَالَ : حَدَّثَنِي مَالِكٌ ، وَأَخْبَرَنِي يُونُسُ ، عَنِ ابْنِ شِهَابٍ ، أَخْبَرَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ عُتْبَةَ ، أَنَّ ابْنَ عَبَّاسٍ أَخْبَرَهُ ، عَنْ عُمَرَ رَضِيَ اللَّهُ عَنْهُمْ ، قَالَ : " حِينَ تَوَفَّى اللَّهُ نَبِيَّهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّ الْأَنْصَارَ اجْتَمَعُوا فِي سَقِيفَةِ بَنِي سَاعِدَةَ ، فَقُلْتُ لِأَبِي بَكْرٍ : انْطَلِقْ بِنَا ، فَجِئْنَاهُمْ فِي سَقِيفَةِ بَنِي سَاعِدَةَ " .
Narrated `Umar: When Allah took away the soul of His Prophet at his death, the Ansar assembled In the shed of Bani Sa`ida. I said to Abu Bakr, "Let us go." So, we come to them (i.e. to Ansar) at the shed of Bani Sa`ida. (See Hadith No. 19, Vol. 5 for details)

Hadith Commentary:
The purpose of Imam Bukhari rahimahullah in this chapter is to show that it is a common practice in towns and villages for both the general public and the elite to have a communal gathering place (chopal). Accordingly, in Madinah al-Munawwarah, the Ansar of the tribe of Banu Sa'idah also had such a chopal. Public affairs were conducted there, and it was at this very place that the matter of pledging allegiance (bay'ah) to the leadership and caliphate of Hazrat Abu Bakr as-Siddiq radi Allahu anhu was resolved.

Hadith Commentary:

Public places are for the benefit of the general populace; there is no need to seek anyone’s permission there.
Such places are established for public welfare, therefore it is permissible to benefit from them without permission.

The relevance to the Book of Oppressions (Kitab al-Mazalim) is that sitting in such places, which are made for public benefit, is not oppression. Thus, the Messenger of Allah (sallallahu alayhi wa sallam), Abu Bakr al-Siddiq, and Umar (radi Allahu anhuma) sat in the Saqifah of Banu Sa‘idah, but did not seek permission from its owners.
At this point, this hadith is extremely brief; it will be discussed in detail in the Book of Hudud, and its related benefits will also be mentioned there.
