Hadith 2454

حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ ، حَدَّثَنَا مُوسَى بْنُ عُقْبَةَ ، عَنْ سَالِمٍ ، عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ أَخَذَ مِنَ الْأَرْضِ شَيْئًا بِغَيْرِ حَقِّهِ خُسِفَ بِهِ يَوْمَ الْقِيَامَةِ إِلَى سَبْعِ أَرَضِينَ " . قَالَ عَبْدِ اللهِ : هَذَا الْحَدِيثُ لَيْسَ بِخُرَاسَانَ فِي كِتَابِ ابْنُ الْمُبَارَكِ أَمْلاهُ عَلَيْهِم بِالْبَصْرَةِ .
Narrated Salim's father (i.e. `Abdullah): The Prophet said, "Whoever takes a piece of the land of others unjustly, he will sink down the seven earths on the Day of Resurrection."

Hadith Commentary:

Some people think that it is not possible to usurp land because usurpation (ghasb) only applies to things that can be moved from one place to another and can be handed over or entrusted to someone. Imam Bukhari rahimahullah has described the form of usurping land: if someone unlawfully seizes even a small portion of land, then on the Day of Resurrection he will be sunk into the earth, and the usurped land will be like a collar around his neck. His neck will be lengthened so that the land can become his collar.

In this hadith, there is a clear warning for those who usurp the rights of others, especially those individuals who unlawfully seize land and then build a mosque or madrasa upon it. They think that by doing so they have performed a righteous deed, but there is no virtue in such an act.
