Hadith 2259

حَدَّثَنَا حَجَّاجٌ . ح وحَدَّثَنِي عَلِيُّ بْنُ عَبْدِ اللهِ ، حَدَّثَنَا شَبَابَةُ ، حَدَّثَنَا شُعْبَةُ ، حَدَّثَنَا أَبُو عِمْرَانَ ، قَالَ : سَمِعْتُ طَلْحَةَ بْنَ عَبْدِ اللهِ ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا ، قُلْتُ : يَا رَسُولَ اللهِ ، إِنَّ لِي جَارَيْنِ فَإِلَى أَيِّهِمَا أُهْدِي ؟ قَالَ : إِلَى أَقْرَبِهِمَا مِنْكِ بَابًا " .
Narrated Aisha: I said, "O Allah's Apostle! I have two neighbors and would like to know to which of them I should give presents." He replied, "To the one whose door is nearer to you."

Hadith Commentary:

Qastallani rahimahullah said that this does not establish the permissibility of pre-emption (shuf‘ah).

Hafiz rahimahullah said that the hadith of Abu Rafi‘ establishes the right of pre-emption (shuf‘ah) for the neighbor. Now, from this hadith, Imam Bukhari rahimahullah deduced that if there are several neighbors, then the neighbor whose door is closest to the property being sold should be given precedence in the right of pre-emption (shuf‘ah).

Ibn Battal rahimahullah says:
This hadith does not establish the right of pre-emption (shuf‘ah) for the neighbor, because ‘A’ishah radi Allahu anha had asked: “If there are several neighbors, to whom should I give first?” The same point has been mentioned by Amin Ahsan Islahi, that the neighbor who is closer is more deserving that the gift be sent to him, but the matter of selling land or property is entirely different from giving and receiving gifts.
He further writes that he did not understand why the Imam (Imam Bukhari) brought this narration about giving a gift to a neighbor here, and what its connection is with shuf‘ah? (Tadabbur Hadith: 1/544)
If only the respected author had consulted Fath al-Bari at this point.
Hafiz Ibn Hajar rahimahullah, after quoting this same objection of Ibn Battal, also gave its answer. He says:
Imam Bukhari rahimahullah established the right of pre-emption (shuf‘ah) for the neighbor from the hadith of Abu Rafi‘, and by mentioning the hadith of ‘A’ishah in the Book of Shuf‘ah, he gave precedence to the one who is closer in terms of the door (i.e., proximity) over the one who is farther.
This means that the neighbor whose house is adjacent to the property owner will be given precedence over the other neighbor, i.e., he will have a greater right to shuf‘ah.

The method of these gentlemen is that they take objections from the commentaries of hadith and ignore the answers, even though the commentators mention the objection in order to provide a reasonable answer.
These gentlemen have adopted the same approach regarding the objections they raised on the “Hadith of Ifk.”
May Allah grant them the ability to rectify their actions and beliefs.

The wisdom in giving a gift to the nearby neighbor is that he keeps seeing his neighbor coming and going with fruits and produce, whereas the distant neighbor does not come to know of it. Therefore, the one who lives nearby should be given the gift.

What is the limit of a neighbor? There are multiple opinions narrated regarding this, but all of them are weak. The preferred view appears to be that in determining the boundary of neighborhood, local custom (‘urf) should be taken into consideration.

It is stated: Exchange gifts among yourselves, for this increases love.

Hadith Commentary:
This is an indication that after relatives, the neighbor whose door is closer has more right.
If both doors are at an equal distance, then a distinction can be made between right and left; the one on the right side has more right, or a distinction can also be made between the needy and the non-needy, and a turn can also be assigned.
In any case, sending gifts is a cause of mutual love and brotherhood, so one should not feel ashamed to send even the smallest thing, nor should there be any hesitation in accepting such minor gifts.
