Hadith 2173

قَالَ : وَحَدَّثَنِي زَيْدُ بْنُ ثَابِتٍ ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، رَخَّصَ فِي الْعَرَايَا بِخَرْصِهَا .
Narrated Ibn `Umar from Zaid bin Thabit that the Prophet allowed the selling of the fruits on the trees after estimation (when they are ripe).

Hadith Commentary:
‘Araya is also a type of muzabana.
However, the Prophet (sallallahu alayhi wa sallam) specifically permitted it due to necessity.
That necessity was that people used to give the fruit of one or two trees as charity to a needy person, and then the frequent coming of that person to the orchard would be bothersome to the owner.
So, by estimating the amount of that fruit, the owner would buy that tree from the poor person in exchange for an equivalent amount of dried dates.

Hadith Commentary:

This hadith is actually a part of the narration reported from Abdullah ibn Umar radi Allahu anhu. He himself states that Zayd ibn Thabit radi Allahu anhu narrated this hadith to him. In it, an exceptional case is mentioned in which exchanging fresh fruit for dried fruit is permissible in the case of ‘araya. There are various interpretations regarding this. We will mention only two opinions:
➊ The poor possess dried dates. When the season of fresh dates arrives, they also wish to eat fresh dates. Therefore, they are permitted to purchase fresh dates still on the tree in exchange for dried dates, based on estimation.
➋ A person gives a date palm to a poor individual, allowing him to use its fruit. Then, when the poor person comes to the orchard to eat the fresh dates from that tree, if his coming causes inconvenience to the owner, it is permissible for the owner to give him dried dates instead and keep the tree with its fresh dates for himself.

For the people of ‘araya, it is permitted to exchange up to five wasq, that is, approximately 20 mann, as mentioned in the hadith that the Messenger of Allah sallallahu alayhi wa sallam permitted the sale of ‘ariyah up to five wasq or less.
