Hadith 1848

وَعَضَّ رَجُلٌ يَدَ رَجُلٍ يَعْنِي فَانْتَزَعَ ثَنِيَّتَهُ ، فَأَبْطَلَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " .
A man bit the hand of another man but in that process the latter broke one incisor tooth of the former, and the Prophet forgave the latter.

If a person, out of forgetfulness or unintentionally, wears a shirt (qamees) while in the state of ihram, is there any expiation (fidyah) required or not? In the mentioned hadith, there is no ruling regarding the absence of fidyah; however, Imam Bukhari rahimahullah, in light of his own preference, has presented the statement of Ata’ rahimahullah that there is no fidyah upon such a person.
Since Ata’ rahimahullah is the narrator of this hadith, if fidyah had been obligatory, it would not have remained hidden from him at the very least.
Imam Shafi’i rahimahullah has also adopted this position, whereas Imam Malik rahimahullah holds that if the person removes the shirt immediately or washes off the perfume, then there is no expiation (kaffarah); otherwise, expiation will be required.
In terms of evidences, the position of Imam Bukhari rahimahullah appears to be stronger, because the Messenger of Allah sallallahu alayhi wa sallam ordered him to remove the shirt and wash off the perfume, and said nothing beyond this.

The second hadith is a supplement to the first hadith.
It has no connection with the chapter heading.
It has been mentioned incidentally.
