Hadith 1288

قَالَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا : فَلَمَّا مَاتَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ ذَكَرْتُ ذَلِكَ لِعَائِشَةَ رَضِيَ اللَّهُ عَنْهَا , فَقَالَتْ : رَحِمَ اللَّهُ عُمَرَ ، وَاللَّهِ مَا حَدَّثَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّ اللَّهَ لَيُعَذِّبُ الْمُؤْمِنَ بِبُكَاءِ أَهْلِهِ عَلَيْهِ وَلَكِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , قَالَ : إِنَّ اللَّهَ لَيَزِيدُ الْكَافِرَ عَذَابًا بِبُكَاءِ أَهْلِهِ عَلَيْهِ ، وَقَالَتْ : حَسْبُكُمُ الْقُرْآنُ وَلا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى سورة الأنعام آية 164 , قَالَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا : عِنْدَ ذَلِكَ , وَاللَّهُ هُوَ أَضْحَكَ , وَأَبْكَى , قَالَ : ابْنُ أَبِي مُلَيْكَةَ وَاللَّهِ مَا قَالَ ابْنُ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا شَيْئًا " .
Ibn Abbas added, "When `Umar died I told all this to Aisha and she said, 'May Allah be merciful to `Umar. By Allah, Allah's Apostle did not say that a believer is punished by the weeping of his relatives. But he said, Allah increases the punishment of a non-believer because of the weeping of his relatives." Aisha further added, "The Qur'an is sufficient for you (to clear up this point) as Allah has stated: 'No burdened soul will bear another's burden.' " (35.18). Ibn `Abbas then said, "Only Allah makes one laugh or cry." Ibn `Umar did not say anything after that.

Hadith Commentary:
This verse is from Surah Fatir.
The intent of Imam Bukhari rahimahullah is that no person will be punished for the action of another, except when he also has some form of participation in that action.
For example, if it is a custom in someone's family to wail and lament (niyahah) and he does not prohibit it, then indeed, due to the wailing of his household, he will be punished.
Some have said that the hadith of Umar radi Allahu anhu is to be understood as referring to when the deceased had made a bequest for wailing to be done for him.
Some have said that by "punishment" is meant that the deceased is distressed by the wailing of his household.
Imam Ibn Taymiyyah rahimahullah has also supported this view. The hadith "No soul is killed" () has itself been connected by Imam Bukhari rahimahullah in the chapters of blood money, etc.
From this, Imam Bukhari rahimahullah has deduced that if someone else commits unlawful killing, a portion of the sin is placed upon Qabil, and the reason for this, as explained by the Prophet sallallahu alayhi wa sallam, is that he was the first to establish the precedent of unlawful killing. In the same way, if there is a custom of wailing and lamenting in someone's family and he does not prohibit it, then it is not unlikely that a portion of the sin of those who wail will also be placed upon him and he will be punished.
