Hadith 1076
حَدَّثَنَا
الرَّبِيعُ بْنُ سُلَيْمَانَ ، قَالَ : ثنا
عَبْدُ اللَّهِ بْنُ وَهْبٍ ، قَالَ : سَمِعْتُ
مَالِكَ بْنَ أَنَسٍ يُحَدِّثُ ، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
عُمَرَ بْنِ كَثِيرِ بْنِ أَفْلَحَ ، عَنْ
أَبِي مُحَمَّدٍ مَوْلَى أَبِي قَتَادَةَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : خَرَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ حُنَيْنٍ ، فَلَمَّا الْتَقَيْنَا كَانَتْ لِلْمُسْلِمِينَ جَوْلَةٌ ، قَالَ : فَرَأَيْتُ رَجُلا مِنَ الْمُشْرِكِينَ قَدْ عَلا رَجُلا مِنَ الْمُسْلِمِينَ ، قَالَ : فَاسْتَدَرْتُ لَهُ حَتَّى أَتَيْتُهُ مِنْ وَرَائِهِ ، فَضَرَبْتُهُ عَلَى حَبَلِ عَاتِقِهِ ، وَأَقْبَلَ عَلَيَّ وَضَمَّنِي ضَمَّةً وَجَدْتُ مِنْهَا رِيحَ الْمَوْتِ ، ثُمَّ أَدْرَكَهُ الْمَوْتُ فَأَرْسَلَنِي ، فَلَحِقْتُ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ ، فَقُلْتُ : مَا بَالُ النَّاسِ ؟ قَالَ : أَمْرُ اللَّهِ ، قَالَ : ثُمَّ إِنَّ النَّاسَ رَجَعُوا ، وَجَلَسَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " مَنْ قَتَلَ قَتِيلا لَهُ عَلَيْهِ بَيِّنَةٌ ، فَلَهُ سَلَبُهُ ، قَالَ أَبُو قَتَادَةَ : فَقُمْتُ فَقُلْتُ : مَنْ يَشْهَدُ لِي ؟ ثُمَّ جَلَسْتُ ، ثُمَّ قَالَ : مَنْ قَتَلَ قَتِيلا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ ، قَالَ : فَقُمْتُ فَقُلْتُ : مَنْ يَشْهَدُ لِي ؟ ثُمَّ جَلَسْتُ ، ثُمَّ قَالَ ذَلِكَ الثَّالِثَةَ ، فَقُمْتُ ، فَقَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : مَا لَكَ يَا أَبَا قَتَادَةَ ، قَالَ : فَقَصَصْتُ عَلَيْهِ الْقِصَّةَ ، فَقَالَ رَجُلٌ مِنَ الْقَوْمِ : صَدَقَ يَا رَسُولَ اللَّهِ ، وَسَلَبُ ذَلِكَ الْقَتِيلِ عِنْدِي فَارْضِهِ مِنْ حَقِّهِ ، فَقَالَ أَبُو بَكْرٍ الصِّدِّيقُ رَضِيَ اللَّهُ عَنْهُ : لاهَا اللَّهِ ، إِذًا لا يَعْمِدُ إِلَى أَسَدٍ مِنْ أُسُدِ اللَّهِ يُقَاتِلُ عَنِ اللَّهِ وَرَسُولِهِ فَيُعْطِيكَ سَلَبَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : صَدَقَ أَعْطِهِ إِيَّاهُ ، فَأَعْطَانِي ، قَالَ : فَبِعْتُ الدِّرْعَ فَابْتَعْتُ بِهِ مَخْرَفًا فِي بَنِي سَلَمَةَ ، فَإِنَّهُ لأَوَّلُ مَالٍ تَأَثَّلْتُهُ فِي الإِسْلامِ ، قَالَ : وَالْمَخْرِفُ : النَّخْلُ .
Sayyiduna Abu Qatadah (may Allah be pleased with him) narrates that we set out for the Battle of Hunayn in the company of the Messenger of Allah (peace and blessings of Allah be upon him). When we engaged in battle, chaos spread among the Muslims. He says: I saw a polytheist who had overpowered a Muslim. I circled around and came behind him and struck him with my sword on the tendon of his neck. He turned towards me and squeezed me so hard that I remembered the bitterness of death. Then death overtook him and he let me go. I met Sayyiduna Umar bin Khattab (may Allah be pleased with him) and said to him: Why were the people defeated today? He said: Allah Almighty willed it so. He says: Then everyone returned, and when the Messenger of Allah (peace and blessings of Allah be upon him) sat down, he said: Whoever killed a disbeliever and has proof of it, then the belongings and goods of the slain will belong to him (the killer). Abu Qatadah (may Allah be pleased with him) says: I stood up, then sat down thinking, who will testify for me? He (the Prophet) said again: Whoever killed a disbeliever and has proof of it, then the belongings and goods of the slain will belong to him (the killer). (Abu Qatadah) says: I stood up, then sat down thinking, who will testify for me? The Prophet said the same thing a third time, so I stood up. The Messenger of Allah (peace and blessings of Allah be upon him) asked me: Abu Qatadah! What is the matter? He says: I narrated the whole incident to you. A man said: O Messenger of Allah! He is telling the truth, and the belongings and goods of the slain are with me, so please make him pleased. Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him) said: By Allah! This will not happen, you will not do this, that the Lion of Allah fights in support of Allah and His Messenger, and you give the goods and belongings to yourself. The Messenger of Allah (peace and blessings of Allah be upon him) said: He has spoken the truth, give the goods to him (Abu Qatadah). So he gave me the goods. I sold a coat of mail and bought a garden in the locality of Banu Salamah, and this was the first wealth I acquired in Islam. "Mukhraf" refers to a garden of date palms.
Hadith 1077
Sayyiduna Awf bin Malik Ashja'i and Sayyiduna Khalid bin Walid (may Allah be pleased with them) narrate that the Noble Prophet (peace and blessings of Allah be upon him) did not take out a fifth (khums) from the spoils (belongings of the slain).
