Hadith 1021
أَخْبَرَنَا
مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ ، أَنَّ
ابْنَ وَهْبٍ ، أَخْبَرَهُمْ قَالَ : أَنِي
يُونُسُ بْنُ يَزِيدَ وَاللَّيْثُ بْنُ سَعْدٍ ، عَنِ
ابْنِ شِهَابٍ ، أَنَّ
عُرْوَةَ بْنَ الزُّبَيْرِ ، حَدَّثَهُ ، أَنَّ
عَبْدَ اللَّهِ بْنَ الزُّبَيْرِ حَدَّثَهُ ، عَنِ
الزُّبَيْرِ بْنِ الْعَوَّامِ رَضِيَ اللَّهُ عَنْهُ ، أَنَّهُ خَاصَمَ رَجُلا مِنَ الأَنْصَارِ قَدْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي شِرَاجٍ مِنَ الْحَرَّةِ كَانَا يَسْقِيَانِ بِهِ كِلاهُمَا النَّخْلَ ، فَقَالَ الأَنْصَارِيُّ : سَرِّحِ الْمَاءَ يَمُرُّ فَأَبَى عَلَيْهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اسْقِ يَا زُبَيْرُ ، ثُمَّ أَرْسِلِ الْمَاءَ إِلَى جَارِكَ " ، فَغَضِبَ الأَنْصَارِيُّ ، قَالَ : يَا رَسُولَ اللَّهِ ، أَنْ كَانَ ابْنَ عَمَّتِكَ ، فَتَلَوَّنَ وَجْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، ثُمَّ قَالَ : " اسْقِ يَا زُبَيْرُ ، ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجِذْرِ " ، وَاسْتَوْعَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلزُّبَيْرِ حَقَّهُ ، وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَبْلَ ذَلِكَ أَشَارَ عَلَى الزُّبَيْرِ بِرَأْيٍ أَرَادَ فِيهِ السَّعَةَ لِلزُّبَيْرِ وَلِلأَنْصَارِيِّ ، فَقَالَ الزُّبَيْرُ : مَا أَحْسَبُ هَذِهِ الآيَةَ إِلا نزلت فِي ذَلِكَ : فَلا وَرَبِّكَ لا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ سورة النساء آية 65 الآيَةَ ، وَأَحَدُهُمَا يَزِيدُ عَلَى صَاحِبِهِ فِي الْقِصَّةِ .
Sayyiduna Zubair bin Al-Awwam (may Allah be pleased with him) narrates that he and an Ansari man, who had participated in the Battle of Badr with the Prophet Muhammad (peace and blessings be upon him), came to the Messenger of Allah (peace and blessings be upon him) regarding a dispute about the water channels of Harrah (a place near Madinah), from which both of them used to irrigate their date palms. The Ansari said: Let the water flow, do not stop it, while (Zubair) was refusing him. The Messenger of Allah (peace and blessings be upon him) said: Zubair! After irrigating your land, let the water flow to your neighbor. The Ansari became angry and said: O Messenger of Allah! He is your aunt’s son, that is why you have decided in this way. The face of the Messenger of Allah (peace and blessings be upon him) changed color (with anger), then he said: Zubair! After irrigating your land, hold the water until it reaches the embankments. The Messenger of Allah (peace and blessings be upon him) gave Zubair his full right, whereas previously he had given Zubair advice from himself in which there was room for both Zubair and the Ansari. Zubair says: I think this verse was revealed about this matter: ﴿فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ﴾ (An-Nisa: 65) (By your Lord! They cannot be believers until they make you judge in all disputes between them.) One narrator has narrated the incident in more detail than the other.
Hadith 1013
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) called the Ansar and wanted to grant them plots of land in Bahrain as estates, but they said: "We will not take them until you give them to our Muhajir brothers as well." He said: "After me, others will be given preference over you, so be patient until you meet me."
Hadith 1014
Lady Aisha (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings of Allah be upon him) said: Whoever revives barren land that does not belong to anyone, then he is entitled to it. Urwah says: During his caliphate, Sayyiduna Umar bin Khattab (may Allah be pleased with him) made the same decision.
Hadith 1015
Sayyiduna Samurah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: Whoever builds a wall around barren land (and cultivates it), then the enclosed land will belong to him.
Hadith 1016
Sayyiduna Sa’b bin Jathamah (may Allah be pleased with him) reports that I heard the Messenger of Allah (peace and blessings be upon him) say: The pasture is only for Allah and His Messenger.
Hadith 1017
Sayyiduna Abu Huraira (may Allah be pleased with him) reports that the Noble Prophet (peace and blessings be upon him) said: If there is a dispute regarding a pathway, its width will be seven handspans.
Hadith 1018
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: The width of the road should be seven handspans.
Hadith 1019
Sayyiduna Sa'id bin Zayd bin 'Amr bin Nufayl (may Allah be pleased with him) narrates that I heard the Messenger of Allah (peace and blessings be upon him) say: Whoever seizes (takes possession of) someone else's land, a collar of seven earths will be put around his neck on the Day of Resurrection.

الأَعْرَجِ ، عَنْ
أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِذَا اسْتَأْذَنَ أَحَدُكُمْ جَارَهُ أَنْ يَغْرِزَ خَشَبَةً فِي حَائِطٍ فَلا يَمْنَعْهُ " ، فَلَمَّا قَضَى أَبُو هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ حَدِيثَهُ طَأْطَئُوا رُءُوسَهُمْ ، قَالَ : مَالِي أَرَاكُمْ عَنْهَا مُعْرِضِينَ ، وَاللَّهِ لأَرْمِيَنَّهَا بَيْنَ أَكْتَافِكُمْ .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: When someone asks his neighbor for permission to place wood (such as a beam, etc.) on his wall, he should not prevent him. When Sayyiduna Abu Hurairah (may Allah be pleased with him) finished his narration, the listeners lowered their heads. He said: What is the matter, I see that you are turning away from this? By Allah! I will certainly convey it among your shoulders.
Hadith 1012
حَدَّثَنَا
مُحَمَّدُ بْنُ يَحْيَى ، قَالَ : ثنا
عَبْدُ الرَّزَّاقِ ، قَالَ : أنا
مَعْمَرٌ ، عَنْ
هَمَّامٍ ، عَنْ
أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَرَضَ عَلَى قَوْمٍ الْيَمِينَ ، فَأَسْرَعَ الْفَرِيقَانِ جَمِيعًا ، فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُسْهَمَ بَيْنَهُمْ فِي الْيَمِينِ أَيُّهُمْ يَحْلِفُ " .
Abu Huraira (may Allah be pleased with him) narrates that the Prophet Muhammad (peace and blessings be upon him) presented an oath to some people, so both groups began to hasten in taking the oath. The Prophet (peace and blessings be upon him) ordered that lots be drawn between them to decide who would take the oath.
Hadith 1022
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates that one of the wives of the Prophet (peace and blessings be upon him) sent food for him in a bowl as a gift. Sayyidah Aisha (may Allah be pleased with her) struck the bowl with her hand, causing it to fall and break. The Prophet (peace and blessings be upon him) said: "Provide food like the food and a bowl like the bowl."
Hadith 1023
Sayyiduna Abu Umamah Bahili (may Allah be pleased with him) narrates that I heard the Messenger of Allah (peace and blessings be upon him) saying during the Farewell Pilgrimage: The borrowed item must be returned, the animal given for milk must be returned, the debt must be repaid, and the guarantor must pay the compensation.
Hadith 1024
Sayyiduna Samurah bin Jundub (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whatever the hand takes, it remains a responsibility upon him until it is repaid.
Hadith 1025

هِشَامٍ ، قَالَ : أَخْبَرَنِي أَبِي
عُروة ، عَنْ
عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، أَنَّ هِنْدًا بِنْتَ عُتْبَةَ ، قَالَتْ : يَا رَسُولَ اللَّهِ ، إِنَّ أَبَا سُفْيَانَ رَجُلٌ شَحِيحٌ ، وَلا يُعْطِينِي وَوَلَدِي مَا يَكْفِينَا إِلا مَا أَخَذْتُ مِنْ مَالِهِ وَهُوَ لا يَعْلَمُ ، قَالَ : " خُذِي مَا يَكْفِيكِ وَوَلَدَكِ بِالْمَعْرُوفِ " .
Lady Aisha (may Allah be pleased with her) narrates that Hind bint Utbah said: O Messenger of Allah! Abu Sufyan is a miser; he does not give me and my children enough expenses to suffice us, except that I take from his wealth secretly. The Prophet said: Take from his wealth in a reasonable manner what is sufficient for you and your children.
Hadith 1026
Sayyiduna Samurah (may Allah be pleased with him) reports that the Noble Prophet (peace and blessings be upon him) said: Whoever recognizes his goods with a (bankrupt person), then he should take them from him. Also, if someone has bought them from him, he can take them back from that person as well.
Hadith 1027
Abu Sa'id al-Khudri (may Allah be pleased with him) reports that during the time of the Messenger of Allah (peace and blessings be upon him), a man suffered a loss in the purchase of fruits, which caused him to incur a large debt. The Messenger of Allah (peace and blessings be upon him) said: "Give charity to him." The people gave charity, but the debt was not fully paid off. The Messenger of Allah (peace and blessings be upon him) said: "Take whatever is given to you; beyond that, you have nothing."
Hadith 1028
Abu Wahb says that Sayyiduna 'Adā’ bin Khālid bin Hawdhah said to me: Shall I not read to you the letter which the Messenger of Allah (peace and blessings be upon him) wrote and gave to me? I said: Yes! So he took out a letter in which it was written: This document is regarding what 'Adā’ bin Khālid bin Hawdhah purchased from Muhammad, the Messenger of Allah (peace and blessings be upon him); he bought a slave or a slave-girl from you. There is no deception, evil, or trickery in the mutual trade of the Muslims.
Hadith 996
Abu Huraira (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: When a ruler makes a judgment through ijtihad (striving) and is correct, he receives two rewards, and when a ruler makes a judgment through ijtihad but it is incorrect, he still receives one reward. Abu Muhammad says: We do not know that anyone other than Mu’ammar has narrated this hadith from Thawri.

عُقْبَةَ بْنِ الْحَارِثِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : وَقَالَ ابْنُ أَبِي مُلَيْكَةَ : وَقَدْ سَمِعْتُ مِنْ عُقْبَةَ أَيْضًا ، قَالَ " تَزَوَّجْتُ امْرَأَةً عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : فَجَاءَتِ امْرَأَةٌ سَوْدَاءُ فَزَعَمَتْ أَنَّهَا أَرْضَعَتْهُمَا ، قَالَ : فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرْتُ لَهُ ذَلِكَ ، فَقُلْتُ : إِنَّهَا كَاذِبَةٌ ، قَالَ : فَأَعْرَضَ عَنِّي ، ثُمَّ تَحَوَّلْتُ مِنَ الْجَانِبِ الآخَرِ ، فَقُلْتُ : يَا رَسُولَ اللَّهِ ، فَإِنَّهَا كَاذِبَةٌ ، قَالَ : " فَكَيْفَ يُصْنَعُ بِقَوْلِ هَذِهِ ؟ دَعْهَا عَنْكَ " ، قَالَ مَعْمَرٌ : وَسَمِعْتُ أَيُّوبَ بْنَ مُوسَى ، يَقُولُ : إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : كَيْفَ بِكَ وَقَدْ قِيلَ ؟ .
Sayyiduna Uqbah bin Harith (may Allah be pleased with him) narrates that I married a woman during the time of the Messenger of Allah (peace and blessings be upon him). A black woman came and said that she had suckled both of them. I mentioned this to the Prophet (peace and blessings be upon him) and said: She is lying. The Prophet (peace and blessings be upon him) turned away from me. I came from the other side and said: O Messenger of Allah! She is lying. He said: What should be done about her (the woman)? Divorce her. Mu’ammar says: I heard from Ayyub, he was saying that the Prophet (peace and blessings be upon him) said: When this has been said, how can she remain with you?
Hadith 1010

ابْنُ أَبِي مُلَيْكَةَ ، قَالَ : ثني
عُقْبَةُ بْنُ الْحَارِثِ ، ثُمَّ قَالَ : لَمْ يُحَدِّثْنِي ، وَلَكِنْ سَمِعْتُهُ يُحَدِّثُ ، قَالَ : تَزَوَّجْتُ بِنْتَ أَبِي إِهَابٍ ، فَجَاءَتِ امْرَأَةٌ سَوْدَاءُ ، فَقَالَتْ : إِنِّي قَدْ أَرْضَعْتُكُمَا ، فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلْتُهُ فَأَعْرَضَ عَنِّي ، ثُمَّ سَأَلْتُهُ فَأَعْرَضَ عَنِّي ، فَقَالَ فِي الرَّابِعَةِ أَوِ الثَّالِثَةِ : " كَيْفَ بِكَ وَقَدْ قِيلَ ؟ قَالَ : فَنَهَاهُ عَنْهَا " .
Sayyiduna Uqbah bin Harith (may Allah be pleased with him) narrates that I married the daughter of Abu Ihab. A dark-skinned woman came and said: I have suckled both of you. I asked the Prophet (peace and blessings of Allah be upon him) about this matter, and he turned away from me. I asked again, and he turned away from me again. On the third or fourth time, the Prophet (peace and blessings of Allah be upon him) said: When this has been said, how can she remain with you? Thus, he forbade me from staying with (that wife).
Hadith 1009
Abu Huraira (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: The testimony of a nomad against the townspeople is not permissible.
Hadith 1008
Sayyiduna Jabir (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) gave a verdict based on an oath and a witness.

Sayyiduna Abu Hurairah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) gave a verdict based on an oath and one witness.
Hadith 1006
Abdullah bin Abbas (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him) gave a verdict based on one witness and an oath. (For a verdict, two witnesses are required; if there are not two witnesses, then a verdict is given based on one witness and the plaintiff's oath.) Ali bin Abdullah says: I asked Yahya bin Saeed about Saif bin Sulaiman, so he said: According to us, he was reliable, among the truthful and those with good memory.

الْحَارِثُ بْنُ سَلْمَانَ الْكِنْدِيُّ ، قَالَ : ثنا
كُرْدُوسٌ ، عَنِ
الأَشْعَثِ بْنِ قَيْسٍ الْكِنْدِيِّ رَضِيَ اللَّهُ عَنْهُ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّ رَجُلا مِنْ كِنْدَةَ ، وَرَجُلا مِنْ حَضْرَمَوْتَ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي أَرْضٍ بِالْيَمَنِ ، فَقَالَ الْحَضْرَمِيُّ : يَا رَسُولَ اللَّهِ ، أَرْضِي اغْتَصَبَنِيهَا أَبُو هَذَا ، فَقَالَ لِلْكِنْدِيِّ : مَا تَقُولُ ؟ قَالَ : أَقُولُ : إِنَّهَا أَرْضٌ فِي يَدِي وَرِثْتُهَا مِنْ أَبِي ، فَقَالَ لِلْحَضْرَمِيِّ : هَلْ لَكَ مِنْ بَيِّنَةٍ ؟ قَالَ : لا ، وَلَكِنْ لِيَحْلِفْ يَا رَسُولَ اللَّهِ بِاللَّهِ الَّذِي لا إِلَهَ إِلا هُوَ مَا يَعْلَمُ أَنَّهَا أَرْضِي اغْتَصَبَنِيهَا أَبُوهُ ، فَتَهَيَّأَ الْكِنْدِيُّ لِلْيَمِينِ ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّهُ لا يَقْتَطِعُ رَجُلٌ مَالا بِيَمِينِهِ إِلا لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ وَهُوَ أَجْذَمُ " ، فَرَدَّهَا الْكِنْدِيُّ .
Sayyiduna Ash’ath bin Qais Kindi (may Allah be pleased with him) reports from the Messenger of Allah (peace and blessings be upon him) that a man from Kinda and a man from Hadhramaut brought a case regarding land in Yemen before the Messenger of Allah (peace and blessings be upon him). The man from Hadhramaut said: O Messenger of Allah! His (the Kindi’s) father had wrongfully seized my land. The Prophet (peace and blessings be upon him) said to the Kindi: What do you say? He replied: I say that the land is in my possession and I inherited it from my father. The Prophet (peace and blessings be upon him) asked the man from Hadhramaut: Do you have any proof? He said: O Messenger of Allah! I have no proof, but let him swear by the One besides whom there is no deity, that he does not know that this land is mine and that his father forcibly took it from me. The Kindi was ready to swear, so the Messenger of Allah (peace and blessings be upon him) said: Whoever seizes someone’s wealth through (a false) oath will meet Allah on the Day of Resurrection with his hand cut off. So the Kindi returned the land to him.

أَبُو عَوَانَةَ ، قَالَ : ثنا
عَبْدُ الْمَلِكِ يَعْنِي ابْنَ عُمَيْرٍ ، عَنْ
عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ
وَائِلِ بْنِ حُجْرٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : كُنْتُ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَتَاهُ رَجُلانِ يَخْتَصِمَانِ فِي أَرْضٍ ، قَالَ أَحَدُهُمَا : إِنَّ هَذَا افْتَرَى عَلَى أَرْضِي يَا رَسُولَ اللَّهِ فِي الْجَاهِلِيَّةِ ، وَهُوَ امْرُؤُ الْقَيْسِ بْنُ عَابِسٍ الْكِنْدِيُّ ، وَخَصْمُهُ رَبِيعَةُ بْنُ عِيدَانَ ، فَقَالَ لَهُ : بَيِّنَتُكَ ، قَالَ : لَيْسَ لِي ، قَالَ : يَمِينُهُ ، قَالَ : إِذًا يَذْهَبُ بِهَا ، قَالَ : لَيْسَ لَكَ إِلا ذَلِكَ ، قَالَ : فَلَمَّا قَامَ يَحْلِفُ ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ اقْتَطَعَ أَرْضًا ظُلْمًا لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ " .
Sayyiduna Wa'il bin Hujr (may Allah be pleased with him) narrates that I was with the Messenger of Allah (peace and blessings be upon him) when two men came to him with a dispute over land. One of them, whose name was Amr ibn Qais bin Abis Kindi, said: O Messenger of Allah! He seized my land during the time of ignorance. His opponent was Rabi'ah bin 'Idan. The Prophet (peace and blessings be upon him) asked him: Do you have any evidence? He said: No! The Prophet (peace and blessings be upon him) said: Then he will be made to swear an oath. He said: Then he will take the land! The Prophet (peace and blessings be upon him) said: This is the only option you have. The narrator says: When he stood up to take the oath, the Messenger of Allah (peace and blessings be upon him) said: Whoever seizes land unjustly from someone, on the Day of Resurrection he will meet Allah while Allah will be angry with him.
Hadith 1003
Sayyiduna Muawiyah bin Haydah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) detained a man for a short while on the charge of slander, then released him.
Hadith 1002
Sayyidah Aisha (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whoever introduces into this matter of ours (religion) something which is not from it, then it is rejected.
Hadith 1001
Abu Huraira (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: Muslims must abide by their conditions, as long as they are in accordance with the truth. The Messenger of Allah (peace and blessings be upon him) also said: It is permissible to reconcile between Muslims.

مَحْمُودُ بْنُ آدَمَ ، قَالَ : ثنا
وَكِيعٌ ، عَنْ
أُسَامَةَ بْنِ زَيْد ، قَالَ : ثنا
عَبْدُ اللَّهِ بْنُ رَافِعٍ مَوْلَى أُمِّ سَلَمَةَ ، عَنْ
أُمِّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : جَاءَ رَجُلانِ مِنَ الأَنْصَارِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَخْتَصِمَانِ فِي مَوَارِيثَ بَيْنَهُمَا قَدْ دَرَسَتْ لَيْسَ بَيْنَهُمَا بَيِّنَةٌ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ ، وَإِنَّمَا أَنَا بَشَرٌ وَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ ، وَإِنَّمَا أَقْضِي بَيْنَكُمْ عَلَى نَحْو مِمَّا أَسْمَعُ مِنْكُمْ فَمَنْ قَضَيْتُ لَهُ مِنْ أَخِيهِ شَيْئًا فَلا يَأْخُذْهُ ، فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ يَأْتِي بِهِ إِسْطَامًا فِي عُنُقِهِ يَوْمَ الْقِيَامَةِ " قَالَ : فَبَكَى الرَّجُلانِ وَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا : حَقِّي لأَخِي ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمَّا إِذْ فَعَلْتُمَا هَذَا ، فَاذْهَبَا فَاقْتَسِمَا وَتَوَخَّيَا الْحَقَّ ، ثُمَّ اسْتَهِمَا ، ثُمَّ لِيَحْلِلْ كُلُّ وَاحِدٍ مِنْكُمَا صَاحِبَهُ " .
Lady Umm Salamah (may Allah be pleased with her) narrates that two Ansari men came to the Messenger of Allah (peace and blessings be upon him), between whom there was an old dispute over inheritance. Neither of them had any evidence. The Prophet (peace and blessings be upon him) said: "You bring your disputes to me, but I am only a human being. It is possible that one of you may be more eloquent in presenting his case than the other, so I decide in his favor according to what I hear. So, if I grant someone a right that belongs to his brother, he should not take it, for I am actually cutting a piece of fire for him, which he will carry around his neck on the Day of Resurrection as a burning brand." The narrator says: Both men began to weep and said, "I give my right to my brother." The Messenger of Allah (peace and blessings be upon him) said: "If you wish to do so, then go and divide the property into two parts with justice and fairness, then draw lots between yourselves, and both of you forgive each other."
Hadith 999
Lady Umm Salamah (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) said: "You bring your disputes to me, and I am only a human being. It is possible that one of you may be more eloquent in presenting his case than the other. If I judge in favor of someone, granting him a right that belongs to his brother, then I am in fact cutting a piece of fire for him. Therefore, he should not take anything from it." These are the words of the hadith narrated by Harun bin Ishaq.
Hadith 998
Sayyiduna Abdur Rahman bin Samurah رضي الله عنه reports that the Messenger of Allah صلى الله عليه وسلم said: Do not ask for leadership; if it is given to you without your asking, you will be helped in it, but if it is given to you because of your request, you will be left to it.
Hadith 997
Sayyiduna Abu Bakrah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: If a judge is in a state of anger, he should not decide between two people.
