Al-Muntaqa Ibn al-Jarud

Sayyiduna Ubadah bin Samit (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: Learn from me, Allah Almighty has made a way out for those (adulterous) women. If a married man commits adultery with a married woman, he will be given one hundred lashes, then stoned to death. And if an unmarried boy commits adultery with an unmarried girl, he will be given one hundred lashes and exiled for one year.

Sayyiduna Abu Hurairah, Sayyiduna Zaid bin Khalid, and Sayyiduna Shibl (may Allah be pleased with them) narrate that we were with the Prophet Muhammad (peace and blessings be upon him) when a man came and said: I beseech you by Allah to judge between us according to the Book of Allah. His opponent, who was more intelligent, also stood up and said: Yes, judge between us according to the Book of Allah and allow me to speak. The Prophet (peace and blessings be upon him) said: Speak. He said: My son was working for them, and he committed adultery with their wife. I was informed that my son’s punishment is stoning, so I gave one hundred sheep and a slave as compensation. After that, I asked the scholars, and they told me that my son’s punishment is one hundred lashes and one year of exile, and the woman’s punishment is stoning. The Prophet (peace and blessings be upon him) said: I will judge between you according to the Book of Allah. The one hundred sheep and the slave will be returned, and your son’s punishment is one hundred lashes and one year of exile. Anis! Go to this man’s wife, and if she confesses, then stone her.

Sayyiduna Umar (may Allah be pleased with him) narrates that I fear that if a long time passes over the people, someone may say: "We do not find the ruling of stoning (rajm) in the Book of Allah," thus they will go astray by rejecting an obligation revealed by Allah. Listen! Whoever commits adultery while being married, and proof is established against him, or there is pregnancy, or he confesses, then stoning is the truth. Listen! The Messenger of Allah (peace and blessings be upon him) carried out stoning, and we also stoned along with him.

Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates that a man from the tribe of Aslam came to the Messenger of Allah (peace and blessings be upon him) and confessed to committing adultery. Then he confessed again, so the Prophet (peace and blessings be upon him) turned his face away. He confessed again, and the Prophet (peace and blessings be upon him) turned his face away again, until he testified against himself four times. Then the Prophet (peace and blessings be upon him) asked him: "Are you insane?" He replied, "No!" The Prophet (peace and blessings be upon him) asked: "Are you married?" He replied, "Yes!" Sayyiduna Jabir (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) gave the order regarding him, so he was stoned to death at the Eid prayer ground. When the stones caused him pain, he ran away, but he was caught and stoned to death until he died. The Prophet (peace and blessings be upon him) expressed good thoughts about him but did not perform his funeral prayer.

Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that Sayyiduna Ma'iz Aslami came to the service of the Noble Prophet (peace and blessings be upon him) and confessed four times that he had committed unlawful intercourse with a woman. Each time, the Prophet turned his face away from him. Then, on the fifth time, the Prophet turned towards him and asked: "Did you have intercourse with her?" He replied: "Yes!" The Prophet asked: "To the extent that your private part entered her private part, just as a needle enters a kohl container and a bucket's rope goes into a well?" He replied: "Yes!" The Prophet asked: "Do you know what adultery is?" He replied: "Yes! I went to her unlawfully, just as a man goes to his wife lawfully." The Prophet asked: "What do you want from this statement (confession)?" He replied: "I want you to purify me." The Prophet ordered regarding him, and he was stoned to death.

The Noble Prophet (peace and blessings be upon him) heard two of his companions, one of whom was saying to the other: "Look at him (Ma'iz), Allah had concealed his sin, but his own self did not leave him until he was stoned like a dog." The Noble Prophet (peace and blessings be upon him) remained silent. Then, after a short while, he walked until he passed by a dead donkey whose leg was raised. He said: "Where are so-and-so and so-and-so?" Both of them replied: "O Messenger of Allah! We are present." He said: "Get down and eat from the flesh of this dead donkey." Both of them said: "O Prophet of Allah! May Allah forgive you, who would eat this?" He said: "What you have just done to your brother's honor is more severe than eating this (carcass). By the One in Whose hand is my soul! He is now diving into the rivers of Paradise."

Sayyiduna Imran bin Husain (may Allah be pleased with him) narrates that a woman from the tribe of Juhaina came to the Prophet (peace and blessings be upon him) and confessed to committing adultery, saying: I have become pregnant. The Prophet (peace and blessings be upon him) called her guardian and said: Treat her well, and when she gives birth, inform me. So he did as instructed. By the order of the Prophet (peace and blessings be upon him), her clothes were tied firmly around her, then he ordered her to be stoned, and she was stoned. Then he offered her funeral prayer. Sayyiduna Umar (may Allah be pleased with him) said: O Messenger of Allah! You stoned her and then also offered her funeral prayer? He replied: She has repented with such a repentance that if it were distributed among seventy people of Madinah, it would suffice them all. Have you found anything better than this, that she sacrificed her own life for the sake of Allah?

Abu Abdur Rahman Salmi says that Sayyiduna Ali (may Allah be pleased with him) addressed us in a sermon and said: O people! Establish the prescribed punishments on your slaves, whether they are married or unmarried. A slave woman of the Messenger of Allah (peace and blessings be upon him) committed adultery, so he ordered me to flog her. When I went to her (to flog her), she had just given birth to a child a short while before. I was afraid that if I flogged her, she would die. So I met the Noble Prophet (peace and blessings be upon him) and mentioned this to him, and he (peace and blessings be upon him) said: You did the right thing.

Abu Umamah bin Sahl bin Hunayf narrates that an Ansari companion informed him that one of them became ill until he became so weak that he was reduced to a skeleton. A slave girl went to him, and he became cheerful and happy with her, and he had intercourse with her. When his people went to visit him, he told them about this (intercourse) and said to them: Ask the Messenger of Allah (peace be upon him) about me, for a slave girl came to me and I ended up having intercourse with her. They mentioned this to the Messenger of Allah (peace be upon him) and said: We have not seen anyone with such an illness as he has. If we were to carry him to you, his bones would break apart; he is only skin and bone. The Messenger of Allah (peace be upon him) ordered them to take one hundred thin branches and strike him once with them.

Sayyiduna Jabir (may Allah be pleased with him) narrates that a man committed adultery. The Messenger of Allah (peace and blessings be upon him) ordered, so he was flogged. Then it was reported to you that he was married, so according to your command, he was stoned. Abu Muhammad says: In the narration of Uthman bin Umar and Abu Asim and others, it is mentioned that a man committed adultery, so he was flogged; the Prophet (peace and blessings be upon him) is not mentioned.

Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that Sayyiduna Ma'iz Aslami came to the Messenger of Allah (peace and blessings be upon him) and said: I have committed adultery. The Prophet turned away from him until he had confessed this four times. Then the Prophet (peace and blessings be upon him) said: Take him away and stone him. So they took him, and when the stoning began, due to the pain from the stones, he ran away. He passed by a man who had a camel's jawbone, and that man struck him with it and killed him. The people mentioned to the Prophet (peace and blessings be upon him) that he had run away due to the pain of the stones, so the Prophet (peace and blessings be upon him) said: Why did you not leave him?

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whoever you find doing the act of the people of Lot, kill both the doer and the one with whom it is done.

Sayyiduna Abu Hurairah and Sayyiduna Zayd bin Khalid al-Juhani (may Allah be pleased with them) narrate that the Messenger of Allah (peace and blessings be upon him) was asked about a slave-girl who is unmarried and commits adultery (what punishment should be given to her). He said: If she commits adultery, flog her; then if she commits adultery again, flog her; then if she commits adultery again, flog her; then if she commits adultery again, sell her, even if it is for a rope. Ibn Shihab Zuhri says: I do not remember whether he said these words the third time or the fourth time. "Dhafeer" means rope.

Sayyiduna Abdullah bin Umar (may Allah be pleased with them) narrates that the Prophet (peace and blessings of Allah be upon him) stoned a Jewish man and woman.
