Hadith 759
حَدَّثَنَا
إِسْحَاقُ بْنُ مَنْصُورٍ ، قَالَ : ثنا
حَمَّادُ بْنُ مَسْعَدَةَ ، عَنْ
سَعْدِ بْنِ إِسْحَاقَ ، عَنْ
عَمَّتِهِ زَيْنَبَ بِنْتِ كَعْبٍ ، عَنِ
الْفُرَيْعَةِ بِنْتِ مَالِكٍ رَضِيَ اللَّهُ عَنْهَا ، أَنَّ زَوْجَهَا خَرَجَ فِي طَلَبِ أَعْلاجٍ لَهُ فَأَدْرَكَهُمْ بِالْقَدُومِ ، فَوَثَبُوا عَلَيْهِ فَقَتَلُوهُ ، وَأَنَّهَا جَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرَتْ لَهُ أَنَّهَا فِي مَنْزِلٍ شَاسِعٍ عَنْ أَهْلِهَا وَأَنَّهَا تُرِيدُ التَّحَوُّلَ إِلَيْهِمْ فَأَذِنَ لَهَا ، قَالَتْ : فَخَرَجْتُ حَتَّى إِذَا كُنْتُ فِي الْحُجُرَاتِ ، أَوْ قَالَتْ : جَاوَزْتُ الْحُجُرَاتِ دَعَانِي ، أَوْ قَالَتْ : أَرْسَلَ إِلَيَّ فَدَعَانِي ، فَقَالَ لِي : " اعْتَدِّي فِي بَيْتِ زَوْجِكِ الَّذِي جَاءَكَ فِيهِ نَعْيُهُ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ " ، قَالَتْ : فَلَمَّا كَانَ زَمَنُ عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ بَعَثَ إِلَيَّ فَسَأَلَنِي ، فَحَدَّثْتُهُ .
Fari’ah bint Malik (may Allah be pleased with her) narrates that her husband went out in search of his (Abyssinian) slaves and found them at a place called Qudum. They attacked and killed him. She came to the Messenger of Allah (peace and blessings be upon him) and related her story, also mentioning that she lived in a house far from her family, so she wished to return to her parental home. The Prophet (peace and blessings be upon him) granted her permission. Fari’ah says: When I reached near the chambers or had gone beyond them, he called me back or sent for me and said: Complete your waiting period (‘iddah) in your husband’s house, where you received the news of his death. Fari’ah says: During the caliphate of Sayyiduna ‘Uthman (may Allah be pleased with him), he sent for me to ask about this matter, and I informed him.
Hadith 760

أَحْمَدُ بْنُ نَصْرٍ ، قَالَ : أنا
مُحَمَّدُ بْنُ حَرْبٍ ،
وَعَبْدُ الْعَزِيزِ بْنُ عَبْدِ اللَّهِ الأُوَيْسِيُّ ، عَنْ
مَالِكٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الأَسْوَدِ بْنِ سُفْيَانَ ، عَنْ
أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ
فَاطِمَةَ بِنْتِ قَيْسٍ رَضِيَ اللَّهُ عَنْهَا ، أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ ، طَلَّقَهَا الْبَتَّةَ وَهُوَ غَائِبٌ ، فَأَرْسَلَ إِلَيْهَا وَكِيلَهُ بِشَعِيرٍ فَسَخِطَتْهُ ، فَقَالَ : وَاللَّهِ مَا لَكِ عَلَيْنَا مِنْ شَيْءٍ ، فَجَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ ، فَقَالَ : " لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ ، وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ، ثُمَّ قَالَ : تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي ، فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ ، فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ ، فَإِذَا حَلَلْتِ فَآذِنِينِي " ، قَالَتْ : فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ ، وَأَبَا جَهْمٍ خَطَبَانِي ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمَا أَبُو جَهْمٍ فَلا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ ، وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لا مَالَ لَهُ ، انْكِحِي أُسَامَةَ بْنَ زَيْدٍ ، قَالَتْ : فَكَرِهْتُ ، ثُمَّ قَالَ : انْكِحِي أُسَامَةَ بْنَ زَيْدٍ ، فَنَكَحْتُهُ فَجَعَلَ اللَّهُ فِيهِ خَيْرًا وَاغْتَبَطْتُ بِهِ " .
Lady Fatimah bint Qais (may Allah be pleased with her) narrates that Abu Amr bin Hafs divorced her with a final (irrevocable) divorce in his absence and sent some barley with his agent. She became upset upon seeing the small amount of barley. He said: By Allah! You have no right over us. She went to the Messenger of Allah (peace and blessings be upon him) and presented the whole matter before him. The Prophet (peace and blessings be upon him) said to her: You have no maintenance from them. He ordered her to spend her waiting period in the house of Umm Sharik, then said: Umm Sharik is a woman whom my companions frequently visit, so spend your waiting period in the house of Ibn Umm Maktum, for he is a blind man. If you happen to remove your clothes (suddenly), there is no harm, and when your waiting period is complete, inform me. She narrates: When my waiting period was complete, I informed him that Muawiyah bin Abu Sufyan and Abu Jahm bin Hudhayfah had proposed marriage to me. The Messenger of Allah (peace and blessings be upon him) said: Abu Jahm is a man who beats women a lot, and Muawiyah is a poor man, he has no wealth, so marry Usamah bin Zaid. Fatimah said: I did not like him. The Prophet (peace and blessings be upon him) again said: Marry Usamah bin Zaid. So I married him, and Allah placed so much goodness and blessing in it that I began to envy him.
Hadith 761
Sayyida Fatimah bint Qays (may Allah be pleased with her) narrates that her husband gave her three divorces, so the Messenger of Allah (peace and blessings be upon him) did not grant her the right to residence or maintenance.
Hadith 762

مُحَمَّدُ بْنُ يَحْيَى ، قَالَ : ثنا
يَزِيدُ بْنُ هَارُونَ ، قَالَ : أنا
يَحْيَى يَعْنِي ابْنَ سَعِيدٍ ، أَنَّ
سُلَيْمَانَ بْنَ يَسَارٍ ، أَخْبَرَهُ ، أَنَّ
أَبَا سَلَمَةَ ، أَخْبَرَهُ أَنَّهُ اجْتَمَعَ هُوَ وَابْنُ عَبَّاسٍ عِنْدَ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُمْ ، " فَذَكَرُوا الرَّجُلَ يَتَوَفَّى عَنِ الْمَرْأَةِ فَتَلِدُ بَعْدَهُ بِلَيَالٍ قَلائِلَ ، فَقَالَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا : حِلُّهَا آخِرُ الأَجَلَيْنِ ، وَقَالَ أَبُو سَلَمَةَ : إِذَا وَضَعَتْ فَقَدْ حَلَّتْ ، فَتَرَاجَعَا فِي ذَلِكَ بَيْنَهُمَا ، فَقَالَ أَبُو هُرَيْرَةَ : أَنَا مَعُ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ ، فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا فَسَأَلَهَا ، فَذَكَرَتْ
أُمُّ سَلَمَةَ أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ الأَسْلَمِيَّةَ مَاتَ عَنْهَا زَوْجُهَا فَنَفِسَتْ بَعْدَهُ لِلَيَالٍ ، وَأَنَّ رَجُلا مِنْ بَنِي عَبْدِ الدَّارِ يُكَنَّى أَبَا السَّنَابِلِ بْنَ بَعْكَكَ خَطَبَهَا ، وَأَخْبَرَهَا أَنَّهَا قَدْ حَلَّتْ ، فَأَرَادَتْ أَنْ تَتَزَوَّجَ غَيْرَهُ ، فَقَالَ لَهَا أَبُو السَّنَابِلِ : فَإِنَّكِ لَمْ تَحِلِّي ، فَذَكَرَتْ ذَلِكَ سُبَيْعَةُ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَهَا أَنْ تَتَزَوَّجَ " .
Sayyiduna Abu Salamah and Abdullah bin Abbas (may Allah be pleased with them both) gathered together with Sayyiduna Abu Hurairah (may Allah be pleased with him) and began discussing the case of a man who dies and, after a few days, his wife gives birth (so which waiting period should the woman observe). Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: Her waiting period will be whichever of the two (delivery or four months and ten days) is completed later. Abu Salamah said: When the child is born, her waiting period will be completed. There was a dispute between the two on this issue, so Sayyiduna Abu Hurairah (may Allah be pleased with him) said: I am with my nephew Abu Salamah. Then he sent Kuraib, the slave of Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both), to ask Sayyidah Umm Salamah (may Allah be pleased with her), so Sayyidah Umm Salamah (may Allah be pleased with her) informed that the husband of Subai’ah bint al-Harith al-Aslamiyyah died and a few days later she gave birth to a child. Then a man from Banu Abd al-Dar, whose kunyah was Abu Sanabil bin Ba’kak, sent her a marriage proposal and informed her that she had become lawful (for marriage). Subai’ah wanted to marry someone else, so Abu Sanabil said: You have not become lawful. Subai’ah mentioned this to the Messenger of Allah (peace and blessings be upon him), so he ordered her to marry.
Hadith 763
Rabi' bint Mu'awwidh (may Allah be pleased with them) narrates that she obtained khul' during the time of the Prophet Muhammad (peace be upon him), so the Prophet Muhammad (peace be upon him) ordered her to observe the waiting period of one menstrual cycle.
Hadith 764
Lady Aisha (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) said: It is not permissible for a woman who believes in Allah and the Last Day to mourn for any deceased person for more than three days.
Hadith 765

حُمَيْدُ بْنُ نَافِعٍ ، عَنْ
زَيْنَبَ بِنْتِ أُمِّ سَلَمَةَ ، عَنْ
أُمِّ حَبِيبَةَ رَضِيَ اللَّهُ عَنْهَا مَاتَ نَسِيبٌ لَهَا ، أَوْ قَرِيبٌ لَهَا ، فَدَعَتْ بِصُفْرَةٍ ، فَمَسَحَتْ ذِرَاعَيْهَا ، وَقَالَتْ : سَمِعْتُ رَسُولَ اللَّهِ ، أَوْ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يَحِلُّ لامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الآخِرِ أَنْ تُحِدَّ عَلَى مَيِّتٍ فَوْقَ ثَلاثٍ إِلا عَلَى زَوْجٍ ، فَإِنَّهَا تُحِدُّ عَلَيْهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا " .
A relative or close kin of Sayyida Umm Habibah (may Allah be pleased with her) passed away, so after three days she sent for yellow color and applied it to her cheeks and said: I heard the Messenger of Allah (peace and blessings of Allah be upon him) say: It is not permissible for a woman who believes in Allah and the Last Day to mourn for any deceased person for more than three days, except for her husband, for whom she will mourn for four months and ten days.
Hadith 766
Sayyida Umm Atiyyah (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) said: It is not permissible for a woman who believes in Allah and the Last Day to mourn for any deceased person for more than three days, except for her husband, for whom she will mourn for four months and ten days. She should not apply kohl, nor wear colored clothing, except for a garment made of dyed yarn (which was dyed before being woven). She should not apply perfume, except when she becomes pure after menstruation (then she may apply a little perfume).
Hadith 767
The noble wife of the Prophet Muhammad (peace be upon him), Sayyida Umm Salama (may Allah be pleased with her), narrates that the Prophet Muhammad (peace be upon him) said: A woman whose husband passes away should not wear yellow or ochre-dyed clothes, nor wear jewelry, nor apply henna, nor apply kohl. Hasan bin Muslim says: In my opinion, there is no harm in applying aloe.
Hadith 768

حُمَيْدُ بْنُ نَافِعٍ ، عَنْ
زَيْنَبَ بِنْتِ أُمِّ سَلَمَةَ ، عَنْ
أُمِّهَا رَضِيَ اللَّهُ عَنْهَا ، " أَنَّ امْرَأَةً تُوُفِّيَ عَنْهَا زَوْجُهَا فَاشْتَكَتْ عَيْنَهَا ، فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَذَكَرُوا الْكُحْلَ ، فَقَالُوا : نَخَافُ عَلَى عَيْنِهَا ، قَالَ : " قَدْ كَانَتْ إِحْدَاكُنَّ تَمْكُثُ فِي بَيْتِهَا فِي شَرِّ أَحْلاسِهَا أَوْ فِي أَحْلاسِهَا فِي شَرِّ بَيْتِهَا حَوْلا ، فَإِذَا مَرَّ كَلْبٌ رَمَتْ بِبَعْرَةٍ ، أَفَلا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا " .
Lady Umm Salamah (may Allah be pleased with her) narrates that a woman's husband passed away, and during her waiting period ('iddah), her eyes began to hurt. People mentioned this to the Prophet Muhammad (peace and blessings be upon him), mentioning the use of kohl (antimony), and said: "We fear for her eyesight." The Prophet (peace and blessings be upon him) said: "A woman (in the days of ignorance) used to stay in her house for a whole year in dirty clothes," or he said: "in dirty clothes and in a dirty house, and when a dog would pass by, she would throw dung (to mark the end of her waiting period), and now she cannot even complete four months and ten days."
Hadith 769
Sayyiduna Amr bin al-As (may Allah be pleased with him) narrates that do not make the Sunnah of our Noble Prophet (peace and blessings of Allah be upon him) doubtful for us. If an umm walad (a slave woman who has borne a child to her master) loses her husband, then her waiting period (‘iddah) is the same as that of a (free) woman whose husband has died.
