Hadith 752
حَدَّثَنَا
عَبْدُ اللَّهِ بْنُ هَاشِمٍ ، قَالَ : ثنا
يَحْيَى يَعْنِي الْقَطَّانَ ، عَنْ
عَبْدِ الْمَلِكِ بْنِ أَبِي سُلَيْمَانَ ، قَالَ : سَمِعْتُ
سَعِيدَ بْنَ جُبَيْرٍ ، يَقُولُ : " سُئِلَتْ عَنِ الْمُتَلاعِنَيْنِ ، أتُفَرَّقُ بَيْنَهُمَا فِي إِمَارَةِ ابْنِ الزُّبَيْرِ رَضِيَ اللَّهُ عَنْهُمَا ؟ فَمَا دَرَيْتُ مَا أَقُولُ ، فَقُمْتُ مَكَانِي إِلَى مَنْزِلِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، فَقُلْتُ :
أَبَا عَبْدِ الرَّحْمَنِ ، الْمُتَلاعِنَانِ أَيُفَرَّقُ بَيْنَهُمَا ؟ قَالَ : سُبْحَانَ اللَّهِ ، نَعَمْ ، إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلانُ بْنُ فُلانٍ ، قَالَ : يَا رَسُولَ اللَّهِ ، " أَرَأَيْتَ الرَّجُلَ مِنَّا يَرَى امْرَأَتَهُ عَلَى فَاحِشَةٍ ، إِنْ تَكَلَّمَ تَكَلَّمَ بِأَمْرٍ عَظِيمٍ ، وَإِنْ سَكَتَ سَكَتَ عَلَى مثل ذَلِكَ ، قَالَ : فَلَمْ يُجِبْهُ ، قَالَ : فَلَمَّا كَانَ مِنَ الْغَدِ أَتَاهُ ، فَقَالَ : الَّذِي سَأَلْتُ عَنْهُ قَدِ ابْتُلِيتُ بِهِ ، فَأَنْزَلَ اللَّهُ هَذِهِ الآيَةَ فِي سُورَةِ النُّورِ : وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ حَتَّى بَلَغَ : وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ سورة النور آية 6 - 9 فَبَدَأَ بِالرَّجُلِ فَوَعَظَهُ وَذَكَّرَهُ ، وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الآخِرَةِ ، فَقَالَ : وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ ، ثُمَّ ثَنَّى بِالْمَرْأَةِ فَوَعَظَهَا وَذَكَّرَهَا ، وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الآخِرَةِ ، فَقَالَتْ : وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنَّهُ لَكَاذِبٌ ، قَالَ : فَبَدَأَ بِالرَّجُلِ فَتَشَهَّدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لِمَنَ الصَّادِقِينَ ، وَالْخَامِسَةَ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ، ثُمَّ ثَنَّى بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لِمَنَ الْكَاذِبِينَ ، وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ، ثُمَّ فَرَّقَ بَيْنَهُمَا " .
Saeed bin Jubair (may Allah have mercy on him) says that during the caliphate of Abdullah bin Zubair (may Allah be pleased with them both), I was asked about the case of the *Mutala‘ineen* (husband and wife who accuse each other of adultery): Should separation be enforced between them? I did not know what answer to give, so I got up from my house and went to the house of Abdullah bin Umar (may Allah be pleased with them both). I asked: Abu Abdur Rahman! Should separation be enforced between the *Mutala‘ineen* (husband and wife)? He said: Subhan Allah! Yes! The first to ask about this was so-and-so, he said: O Messenger of Allah! Tell me, if a man sees his wife committing adultery, what should he do? If he speaks, it is a grave matter; if he remains silent, it is also serious. The Prophet (peace and blessings be upon him) did not give him any answer. The next day, that man came and said: The matter I asked you about, I have now been afflicted by it. So Allah, the Exalted, revealed this verse from Surah An-Nur: “And those who accuse their wives... and the fifth [testimony] should be that the wrath of Allah be upon her if he is among the truthful.” (An-Nur: 6)
Hadith 753
حَدَّثَنَا
الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ ، قَالَ : ثنا
سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ
عَمْرٍو ، عَنْ
سَعِيدِ بْنِ جُبَيْرٍ ، عَنِ
ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، فَرَّقَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَ الْمُتَلاعِنَيْنِ ، وَقَالَ : " حِسَابُكُمَا عَلَى اللَّهِ ، أَحَدَكُمَا كَاذِبٌ لا سَبِيلَ لَكَ عَلَيْهَا ، قَالَ : يَا رَسُولَ اللَّهِ ، مَالِي ؟ قَالَ : لا مَالَ لَكَ عَلَيْهَا ، إِنْ كُنْتَ صَادِقًا عَلَيْهَا فَهُوَ بِمَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا ، وَإِنْ كُنْتَ كاذِبًا فَذَلِكَ أَبْعَدُ لَكَ مِنْهُ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him) separated the husband and wife who performed li'an, and said to them: "Your reckoning is with Allah, one of you is a liar. Now you have no authority over your wife." He asked: "O Messenger of Allah! (At least) return my wealth (dowry)." He replied: "They are not responsible for any of your wealth. If you are truthful, then that wealth was in exchange for her private part, which you made lawful for yourself. And if you are lying, then it is not appropriate for you to demand that wealth."
Hadith 754
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) also narrates that a man invoked li'an against his wife and denied the child (saying that this child is not mine), so the Messenger of Allah (peace and blessings be upon him) separated the two and gave the child to the woman.
Hadith 755
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) narrates that the Messenger of Allah (peace and blessings be upon him) conducted li'an between (Uwaymir) Ajlani and his wife, and she was pregnant.
Hadith 756

الأَوْزَاعِيُّ ، قَالَ : ثني
الزُّهْرِيُّ ، عَنْ
سَهْلِ بْنِ سَعْدٍ رَضِيَ اللَّهُ عَنْهُ ، أَنَّ عُوَيْمِرًا أَتَى عَاصِمَ بْنَ عَدِيٍّ ، فَذَكَرَ بَعْضَ الْحَدِيثِ ، قَالَ : فَلاعَنَهَا ، ثُمَّ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنْ حَبَسْتَهَا فَقَدْ ظَلَمْتَهَا " قَالَ : فَطَلَّقَهَا ، فَكَانَ بَعْدُ سُنَّةً لِمَنْ كَانَ بَعْدَهُمَا مِنَ الْمُتَلاعِنِينَ ، ثُمَّ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " انْظُرُوا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ الْعَيْنَيْنِ عَظِيمَ الأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ ، فَلا أَحْسَبُ عُوَيْمِرًا إِلا وَقَدْ صَدَقَ ، وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةٌ فَلا أَحْسَبُ عُوَيْمِرًا إِلا وَقَدْ كَذَبَ " قَالَ : فَجَاءَتْ بِهِ عَلَى النَّعْتِ الَّذِي نَعَتَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ تَصْدِيقِ عُوَيْمِرٍ ، قَالَ : وَكَانَ يُنْسَبُ بَعْدُ إِلَى أُمِّهِ .
Sayyiduna Sahl bin Sa’d (may Allah be pleased with him) narrates that ‘Uwaymir came to ‘Asim bin ‘Adi (may Allah be pleased with him). Sayyiduna Sahl (may Allah be pleased with him) mentioned part of the hadith, and says: He (‘Uwaymir) performed li‘an (mutual cursing) with his wife, then the Messenger of Allah (peace and blessings be upon him) said: If (now) you keep her in your marriage, then you will be unjust to her. So he divorced her, and after that, this became the established practice for everyone who performed li‘an. Then the Messenger of Allah (peace and blessings be upon him) said: See, if she gives birth to a child who is dark-skinned, with intensely black eyes, broad hips, and thick shins, then I will consider ‘Uwaymir truthful; but if she gives birth to a child who is red-skinned and ugly (short in stature), then I will consider ‘Uwaymir a liar. The narrator says: She gave birth to a child with the characteristics that the Prophet (peace and blessings be upon him) had mentioned in confirmation of ‘Uwaymir. Afterwards, that (child) was attributed to his mother.
