Hadith 629
حَدَّثَنَا
مَحْمُودُ بْنُ آدَمَ ، قَالَ : ثنا
سُفْيَانُ ، عَنِ
الزُّهْرِيِّ ، عَنْ
سَالِمٍ ، عَنْ
أَبِيهِ رَضِيَ اللَّهُ عَنْهُ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَ ، إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever sells a slave who possesses property, then the property belongs to the seller, unless the buyer stipulates a condition."
Hadith 640
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates that the Noble Prophet (peace and blessings of Allah be upon him) commanded to pardon calamities. (That is, if something is destroyed due to a calamity, its price should not be taken.)
Hadith 639
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him) said: "If you sell a date-palm (fruit-bearing tree) to your brother and some calamity befalls it, then it is not permissible for you to take anything from him. Why would you wrongfully take your brother's wealth?"
Hadith 638
Abu Huraira (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: "Reconciliation among Muslims is permissible."
Hadith 637
Sayyiduna Abu Hurairah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: “Muslims must abide by their conditions, which are in accordance with the truth.”
Hadith 636

سَالِمٍ ، عَنْ
جَابِرٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " بِعْنِي جَمَلَكَ ، قَالَ : قُلْتُ : لا ، بَلْ هُوَ لَكَ ، قَالَ : بِعْنِيهِ ، قُلْتُ : فَإِنَّ لِفُلانٍ عَلَيَّ أُوقِيَّةً مِنْ ذَهَبٍ فَهُوَ لَكَ بِهَا فَأَخَذَهُ ، ثُمَّ قَالَ : تَبْلُغُ عَلَيْهِ إِلَى أَهْلِكَ ، فَلَمَّا قَدِمْتُ أَمَرَ بِلالا أَنْ يُعْطِيَنِي " وَذَكَرَ بَاقِيَ الْحَدِيثِ .
Sayyiduna Jabir (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: "Sell me your camel." I replied: "I do not wish to sell it, but you may take it as a gift." He said: "Sell it!" I said: "I owe so-and-so a uqiyah of gold, so in exchange for that, this camel is yours." The Prophet (peace and blessings be upon him) took the camel and said: "Ride it until you reach your home." When I reached home, the Prophet (peace and blessings be upon him) ordered Sayyiduna Bilal (may Allah be pleased with him) to give me a uqiyah. He also narrated the rest of the hadith.
Hadith 635
Sayyiduna Jabir (may Allah be pleased with him) narrates that I sold a camel to the Prophet (peace and blessings of Allah be upon him) and made it a condition that I would ride it until I returned to my home.
Hadith 634
Abu Khaldah Zarqi (may Allah have mercy on him) narrates that we brought a case concerning one of our companions, who had become insolvent, to Abu Hurairah (may Allah be pleased with him). He said: "In a similar case, the Messenger of Allah (peace and blessings be upon him) gave this ruling: Whoever dies or becomes insolvent, the owner of the goods is more entitled to his goods, provided that the goods are exactly as they were."
Hadith 633
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated from the Messenger of Allah (peace and blessings be upon him) regarding bankruptcy. Ibn Yahya says: This narration has also been reported by Malik, Salih bin Kaysan, and Yunus from Zuhri in an unrestricted manner, and their narration is more authentic.
Hadith 632
The same narration is also reported from Sayyiduna Abu Hurairah (may Allah be pleased with him) through another chain of transmission. Additionally, it contains this addition: If someone dies and the property of another person is found with him in its original form, whether the other person has previously taken anything or not, he will be treated like the other creditors.
Hadith 631
Abu Huraira (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: "Whoever sold some goods (on credit) and then found his goods with a person who has become insolvent, and he has not received any of its price, then the goods will belong to him. But if he has received some amount from the buyer, then for the remaining price he will be like the rest of the creditors."
Hadith 630
Abu Huraira (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: "Whoever had people's wealth and became insolvent, and someone finds his exact property with him, then compared to the others, he has more right to take that property."
Hadith 617
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) said: "The buyer and the seller have the option (to cancel the transaction) as long as they have not separated from each other, unless their sale is one with the option (of choice)."

Sayyiduna Abdullah bin Umar (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever sells a grafted date-palm tree, the seller is entitled to its fruit, unless the buyer stipulates a condition."
Hadith 627
Sayyidah Aisha (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "The right to profit belongs to the one who bears the liability for loss."
Hadith 626

مُسْلِمُ بْنُ خَالِدٍ ، عَنْ
هِشَامِ بْنِ عُرْوَةَ ، عَنْ
أَبِيهِ ، عَنْ
عَائِشَةَ رَضِيَ اللَّهُ عَنْها ، أَنَّ رَجُلا اشْتَرَى عَبْدًا فَاسْتَغَلَّهُ ثُمَّ ظَهَرَ مِنْهُ عَلَى عَيْبٍ ، فَخَاصَمَ فِيهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَضَى لَهُ بِرَدِّهِ ، فَقَالَ الْبَائِعُ : يَا رَسُولَ اللَّهِ ، إِنَّهُ قَدْ أَخَذَ خَرَاجَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْخَرَاجُ بِالضَّمَانِ " .
Lady Aisha (may Allah be pleased with her) narrates that a man bought a slave and derived profit (income) from him. Then a defect was discovered in the slave. That man came to the Messenger of Allah (peace and blessings be upon him) disputing, so the Prophet decided to return the slave. The seller said, "O Messenger of Allah! He has already received profit from the slave." The Messenger of Allah (peace and blessings be upon him) said, "The one who is liable for loss is entitled to the profit."

أَبِي عُمَيْسٍ ، قَالَ : أَخْبَرَنِي
عَبْدُ الرَّحْمَنِ بْنُ قَيْسِ بْنِ مُحَمَّدِ بْنِ الأَشْعَثِ ، عَنْ
أَبِيهِ ، عَنْ
جَدِّهِ ، قَالَ : اشْتَرَى الأَشْعَثُ رَقِيقًا مِنْ رَقِيقِ الْخُمْسِ مِنْ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ بِعِشْرِينَ أَلْفًا ، فَأَرْسَلَ عَبْدُ اللَّهِ إِلَيْهِ فِي ثَمَنِهِمْ ، فَقَالَ : إِنَّمَا أَخَذَتْهُمْ بِعَشَرَةِ آلافٍ ، فَقَالَ عَبْدُ اللَّهِ : فَاخْتَرْ رَجُلا يَكُنْ بَيْنِي وَبَيْنَكَ ، قَالَ الأَشْعَثُ : أَنْتَ بَيْنِي وَبَيْنَ نَفْسِكَ ، قَالَ
عَبْدُ اللَّهِ : فَإِنِّي سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ : " إِذَا اخْتَلَفَ الْبَيِّعَانِ وَلَيْسَ بَيْنَهُمَا بَيِّنَةٌ فَهُوَ مَا يَقُولُ رَبُّ السِّلْعَةِ أَوْ يَتَتَارَكَا " .
Muhammad bin Ash’ath, may Allah have mercy on him, narrates that Sayyiduna Ash’ath bin Qais, may Allah be pleased with him, bought a slave from among the slaves of Khums from Sayyiduna Abdullah bin Mas’ud, may Allah be pleased with him, for twenty thousand. Sayyiduna Abdullah, may Allah be pleased with him, sent a man to him for the price, but he said: “I bought him for ten thousand.” Sayyiduna Abdullah bin Mas’ud, may Allah be pleased with him, said: “Let us choose a man who will decide between me and you.” Ash’ath, may Allah be pleased with him, said: “You yourself decide between me and yourself.” Abdullah bin Mas’ud, may Allah be pleased with him, said: “I heard the Messenger of Allah, peace and blessings be upon him, say: When two men involved in a transaction dispute and neither has any evidence, then the statement of the owner of the goods will be accepted, or both will abandon the sale.”

عَمْرُو بْنُ قَيْسٍ ، عَنْ
عُمَرَ بْنِ قَيْسٍ الْمَاصِرِ ، عَنِ
الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ
أَبِيهِ ، قَالَ : بَاعَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ الأَشْعَثَ بْنَ قَيْسٍ سَبْيًا مِنْ سَبْيِ الإِمَارَةِ بِعِشْرِينَ أَلْفًا ، فَجَاءَهُ بِعَشَرَةِ آلافٍ , فَقَالَ : إِنَّمَا بِعْتُكَ بِعِشْرِينَ أَلْفًا ، قَالَ : إِنَّمَا أَخَذْتُهَا بِعَشَرَةِ آلافٍ ، قَالَ : فَإِنِّي أَرْضَى فِي ذَلِكَ بِرَأْيِكَ ، فَقَالَ
ابْنُ مَسْعُودٍ رَضِيَ اللَّهُ عَنْهُ : إِنْ شِئْتَ حَدَّثْتُكَ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَعَلْتُ ، قَالَ : أَجَلْ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا تَبَايَعَ الْمُتَبَايِعَانِ بَيْعًا لَيْسَ بَيْنَهُمَا شُهُودٌ فَالْقَوْلُ مَا قَالَ الْبَائِعُ أَوْ يَتَرَادَّانِ الْبَيْعَ " ، قَالَ الأَشْعَثُ : فَإِنِّي قَدْ رَدَدْتُ عَلَيْكَ .
Abdur Rahman bin Abdullah bin Mas’ud (may Allah have mercy on him) narrates that Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) sold a government slave to Sayyiduna Ash’ath bin Qais (may Allah be pleased with him) for twenty thousand. He brought ten thousand, so Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) said: “I sold you this slave for twenty thousand.” He said: “I bought him for ten thousand.” Ash’ath (may Allah be pleased with him) said: “I am content with your opinion in this matter.” Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) said: “If you wish, I will narrate to you a hadith of the Messenger of Allah (peace and blessings be upon him).” He said: “Alright (narrate it).” He narrated that the Messenger of Allah (peace and blessings be upon him) said: “When two men make a transaction and there is no witness between them, then (in case of dispute) the statement of the seller will be accepted, or both will cancel the sale.” Ash’ath (may Allah be pleased with him) said: “I return the transaction to you.”
Hadith 623
Sayyiduna Samurah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: "If two partners sell (an item), then the sale conducted first will be valid, and if two guardians marry off (a woman), then the marriage conducted first will be valid."
Hadith 622

قَتَادَةَ ، عَنِ
الْحَسَنِ ، عَنْ
سَمُرَةَ رَضِيَ اللَّهُ عَنْهُ ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلأَوَّلِ ، وَأَيُّمَا رَجُلٌ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَالْبَيْعُ لِلأَوَّلِ " .
Sayyiduna Samurah (may Allah be pleased with him) reports that the Noble Prophet (peace and blessings be upon him) said: "If a woman is married off by two guardians, then the first marriage will be valid, and if a man makes a transaction with two men, then the first transaction will be valid."
Hadith 621

أَبُو عَامِرٍ الْعَقَدِيُّ ، قَالَ : ثنا
قُرَّةُ ، عَنْ
مُحَمَّدٍ ، عَنْ
أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنِ اشْتَرَى مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلاثَةَ أَيَّامٍ ، فَإِنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ طَعَامٍ لا سَمْرَاءَ " ، قَالَ أَبُو عَامِرٍ : يَقُولُ : لَيْسَ بُرًّا .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: “Whoever buys a Musarrat (an animal whose milk has been retained in its udders), he has the option for three days; if he wishes to return it, he may return it along with a sa’ of grain, but not wheat.” Abu ‘Amir said: “It should not be wheat.”
Hadith 620
Sayyiduna Abdullah bin Amr (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "The buyer and the seller have the option (to cancel the transaction) as long as they have not separated from each other, unless it is a sale with a stipulated option (i.e., the option to annul the sale has been given). And it is not permissible to separate quickly out of fear that the transaction will be returned."

حَمَّادُ بْنُ زَيْدٍ ، قَالَ : ثنا
جَمِيلُ بْنُ مُرَّةَ ، عَنْ
أَبِي الْوَضِيِّ ، قَالَ : غَزَوْنَا غَزَاةً لَنَا فَنَزَلْنَا مَنْزِلا ، فَبَاعَ صَاحِبٌ لَنَا فَرَسًا مِنْ رَجُلٍ بِعَبْدٍ فَلَبِثَا بَقِيَّةَ يَوْمِهِمَا وَلَيْلَتِهِمَا حَتَّى أَصْبَحَا ، قَالَ : فَلَمَّا حَضَرَ الرَّحْلُ قَامَ الرَّجُلُ إِلَى فَرَسِهِ لِيُسْرِجَهُ وَنَدِمَ ، قَالَ : فَأَخَذَهُ الرَّجُلُ بِالْبَيْعَةِ ، فَأَتَيَا
أَبَا بَرْزَةَ رَضِيَ اللَّهُ عَنْهُ فَقَصَّا عَلَيْهِ قِصَّتَهُمَا ، فَقَالَ : أَتَرْضَيَانِ أَنْ أَقْضِيَ بَيْنَكُمَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا " .
Sayyiduna Abu al-Wadi’ (may Allah be pleased with him) narrates that we participated in a military expedition, and we camped at a certain place. (During this time) one of our companions sold his horse in exchange for a slave, and then he spent the remaining part of the day and night there until morning. When it was time to depart, the man got up to saddle his horse and regretted (selling the horse). Since the other man had bought the horse, he took hold of it. So both of them went to Sayyiduna Abu Barzah (may Allah be pleased with him) and told him this story. He said: “If I judge between you according to the decision of the Messenger of Allah (peace and blessings be upon him), will you accept it?” The Messenger of Allah (peace and blessings be upon him) said: “The buyer and the seller have the right (to cancel the sale) as long as they have not separated from each other.”
Hadith 618
أَخْبَرَنَا
مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ ، أَنَّ
ابْنَ وَهْبٍ أَخْبَرَهُمْ ، قَالَ : أَخْبَرَنِي
اللَّيْثُ بْنُ سَعْدٍ ، أَنَّ
نَافِعًا حَدَّثَهُ ، عَنِ
ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِذَا تَبَايَعَ الرَّجُلانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا ، وَكَانَا جَمِيعًا ، أَوْ يُخَيِّرُ أَحَدُهُمَا الآخَرَ ، فَإِنْ خَيَّرَ أَحَدُهُمَا الآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ ، وَإِنْ تَفَرَّقَا بَعْدَ أَنْ تَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) said: "When two men engage in a transaction, both of them have the option (to cancel the sale) as long as they do not separate. This is the case if both remain in the same place or if they grant each other the option (of canceling the sale). If they grant each other the option and make the sale on that condition, then the sale will be concluded. (Similarly) if, after making the sale, both separate and neither of them rejects the sale, then the sale also becomes binding."
