Hadith 342
حَدَّثَنَا
مُحَمَّدُ بْنُ يَحْيَى ، قَالَ : ثَنَا
مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْمُثَنَّى بْنِ عَبْدِ اللَّهِ بْنِ أَنَسِ بْنِ مَالِكٍ الأَنْصَارِيُّ ، قَالَ : حَدَّثَنِي
أَبِي ، عَنْ
ثُمَامَةَ بْنِ عَبْدِ اللَّهِ بْنِ أَنَسٍ ، أَنَّهُ سَمِعَ
أَنَسَ بْنَ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ ، يَقُولُ : بَعَثَنِي أَبُو بَكْرٍ الصِّدِّيقُ رَضِيَ اللَّهُ عَنْهُ إِلَى الْبَحْرَيْنِ فَكَتَبَ لِي هَذَا الْكِتَابَ : " بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ ، هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْمُسْلِمِينَ ، الَّتِي أَمَرَ اللَّهُ بِهَا رَسُولَهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَمَنْ سُئِلَهَا مِنَ الْمُؤْمِنِينَ عَلَى وجُوهِهَا فَلْيُعْطِهَا ، وَمَنْ سُئِلَ فَوْقَهُ فَلا يُعْطِهِ ، فِي أَرْبَعٍ وَعِشْرِينَ مِنَ الإِبِلِ فَمَا دُونَهَا الْغَنَمُ ، فِي كُلِّ خَمْسٍ شَاةٌ ، فَإِذَا بَلَغَتْ خَمْسًا وَعِشْرِينَ إِلَى خَمْسٍ وَثَلاثِينَ فَفِيهَا بِنْتُ مَخَاضٍ أُنْثَى ، فَإِنْ لَمْ تَكُنْ بِنْتُ مَخَاضٍ أُنْثَى فَابْنُ لَبُونٍ ذَكَرٌ ، فَإِنْ بَلَغَتْ سِتَّةً وَثَلاثِينَ إِلَى خَمْسٍ وَأَرْبَعِينَ فَفِيهَا بِنْتُ لَبُونٍ ، فَإِذَا بَلَغَتْ سِتَّةً وَأَرْبَعِينَ إِلَى سِتِّينَ فَفِيهَا حَقَّةٌ طَرُوقَةُ الْجَمَلِ ، فَإِذَا بَلَغَتْ إِحْدَى وَسِتِّينَ إِلَى خَمْسٍ وَسَبْعِينَ فَفِيهَا جَذَعَةٌ ، فَإِذَا بَلَغَتْ سِتَّةً وَسَبْعِينَ إِلَى تِسْعِينَ فَفِيهَا ابْنَتَا لَبُونٍ ، فَإِذَا بَلَغَتْ إِحْدَى وَتِسْعِينَ إِلَى عِشْرِينَ وَمِائَةٍ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْجَمَلِ ، فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِي كُلِّ أَرْبَعِينَ بِنْتُ لَبُونٍ فَفِي كُلِّ خَمْسِينَ حِقَّةٌ ، فَإِذَا تَبَايَنَ أَسْنَانُ الإِبِلِ فِي فَرَائِضِ الصَّدَقَاتِ مَنْ بَلَغَتْ عِنْدَهُ صَدَقَتُهُ مِنَ الإِبِلِ الْجَذَعَةَ وَلَيْسَتْ عِنْدَهُ جَذَعَةٌ وَعِنْدَهُ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ الْحِقَّةُ وَيُجْعَلُ مَعَهَا شَاتَيْنِ إِنِ اسْتَيْسَرَتَا أَوْ عِشْرِينَ دِرْهَمًا ، فَمَنْ بَلَغَتْ صَدَقَتُهُ الْحِقَّةَ وَلَيْسَتْ عِنْدَهُ الْحِقَّةُ وَعِنْدَهُ الْجَذَعَةُ فَإِنَّهَا تُقْبَلُ مِنْهُ الْجَذَعَةُ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ ، وَمَنْ بَلَغَتْ صَدَقَتُهُ الْحِقَّةَ وَلَيْسَتْ عِنْدَهُ إِلا ابْنَةُ لَبُونٍ فَإِنَّهَا تُقْبَلُ مِنْهُ بِنْتُ لَبُونٍ وَيُعْطِي مَعَهَا شَاتَيْنِ أَوْ عِشْرِينَ دِرْهَمًا ، فَمَنْ بَلَغَتْ صَدَقَتُهُ بِنْتَ لَبُونٍ وَلَيْسَتْ عِنْدَهُ وَعِنْدَهُ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ الْحِقَّةُ وَيُعْطِيهِ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ ، وَمَنْ بَلَغَتْ صَدَقَتُهُ بِنْتَ لَبُونٍ وَلَيْسَتْ عِنْدَهُ وَعِنْدَهُ بِنْتُ مَخَاضٍ فَإِنَّهَا تُقْبَلُ مِنْهُ بِنْتُ مَخَاضٍ وَيُعْطِي مَعَهَا عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ ، وَمَنْ بَلَغَتْ صَدَقَتُهُ بِنْتَ مَخَاضٍ وَلَيْسَتْ عِنْدَهُ وَعِنْدَهُ بِنْتُ لَبُونٍ فَإِنَّهَا تُقْبَلُ مِنْهُ ابْنَةُ لَبُونٍ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ ، فَمَنْ لَمْ يَكُنْ عِنْدَهُ بِنْتُ مَخَاضٍ عَلَى وَجْهِهَا وَعِنْدَهُ ابْنُ لَبُونٍ ذَكَرٌ فَإِنَّهُ يَقْبَلُ مِنْهُ ابْنُ اللَّبُونِ وَلَيْسَ مَعَهُ شَيْءٌ ، فَمَنْ لَمْ يَكُنْ مَعَهُ إِلا أَرْبَعٌ مِنَ الإِبِلِ فَلَيْسَ فِيهَا شَيْءٌ إِلا أَنْ يَشَاءَ رَبُّهَا ، فَإِذَا بَلَغَتْ خَمْسًا مِنَ الإِبِلِ فَفِيهَا شَاةٌ ، وَفِي صَدَقَةِ الْغَنَمِ فِي سَائِمَتِهَا إِذَا كَانَتْ أَرْبَعِينَ شَاةً فَفِيهَا شَاةٌ إِلَى عِشْرِينَ وَمِائَةٍ ، فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ إِلَى أَنْ تَبْلُغَ مِائَتَيْنِ فَفِيهَا شَاتَانِ ، فَإِذَا زَادَتْ عَلَى الْمِائَتَيْنِ إِلَى ثَلاثِمِائَةٍ فَفِيهَا ثَلاثُ شِيَاةٍ ، فَإِذَا زَادَتْ عَلَى ثَلاثِمِائَةِ شَاةٍ فَفِي كُلِّ مِائَةٍ شَاةٌ وَلا يُخْرَجُ فِي الصَّدَقَةِ هَرِمَةٌ وَلا ذَاتُ عَوَارٍ وَلا تَيْسٌ إِلا أَنْ يَشَاءَ الْمُصَدِّقُ وَلا يُجْمَعْ بَيْنَ مُتَفَرِّقٍ وَلا يُفَرَّقْ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ ، وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ ، فَإِذَا كَانَتْ سَائِمَةُ الرَّجُلِ نَاقِصَةً مِنْ أَرْبَعِينَ شَاةً شَاةٌ فَلَيْسَ فِيهَا صَدَقَةٌ إِلا أَنْ يَشَاءَ رَبُّهَا ، وَفِي الرِّقَةِ رُبُعُ الْعَشْرِ ، فَإِذَا لَمْ يَكُنْ مَالُهُ إِلا تِسْعِينَ وَمِائَةَ دِرْهَمٍ فَلَيْسَ فِيهَا صَدَقَةٌ إِلا أَنْ يَشَاءَ رَبُّهَا " .
Bahr bin Hakim narrates from his father, and he from his grandfather, that the Messenger of Allah, peace and blessings be upon him, said: For forty grazing camels, a bint labun is due. Do not move the camels from their place. Whoever pays zakat seeking reward will receive a reward, and whoever does not give zakat, we will take half of his wealth along with the zakat. These are the shares prescribed by our Lord, and nothing from these charities is permissible for the family of Muhammad, peace and blessings be upon him.
Hadith 343
Sayyiduna Mu'adh (may Allah be pleased with him) narrates that the Prophet (peace and blessings of Allah be upon him) sent him to Yemen to collect zakat, and instructed him to take one musinnah (a two-year-old calf) from every forty cows, and one tabi'ah (a one-year-old calf) from every thirty cows.
Hadith 344
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: On thirty cows, one tabi' or tabi'ah (a one-year-old male or female calf) is obligatory as zakat, and on forty cows, one musinnah (a two-year-old male or female calf) is obligatory as zakat.
Hadith 345
Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with both of them) narrates that the Messenger of Allah (peace and blessings be upon him) delivered a sermon to us while standing and said: The zakat of the people should be collected by going to their homes.
Hadith 346
Sayyidah Aisha (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) said: The zakat of the Bedouins should be collected at their water sources (where their animals drink) or near their homes.
Hadith 347
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him) said: On crops irrigated by rivers and springs, one-tenth (ushr) is obligatory as zakat, and on crops irrigated by waterwheels (wells), half of one-tenth (one-twentieth) is obligatory.
Hadith 348
Sayyiduna Abdullah bin Umar (may Allah be pleased with both of them) narrates that the Messenger of Allah (peace and blessings be upon him) prescribed a tithe (one-tenth) as zakat on crops irrigated by rain, springs, or naturally watered land, and half a tithe (one-twentieth) on crops irrigated by buckets.
Hadith 349
Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: Zakat is not obligatory on grain and dates less than five wasq.
Hadith 350
Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with both of them) narrates that Banu Sababah, who were a part of the Fahm tribe, used to pay the Messenger of Allah (peace and blessings be upon him) a tenth (one out of ten water skins) of honey, which was obligatory upon them. The Prophet (peace and blessings be upon him) provided them protection over two valleys. Then, they paid the same tenth that they used to pay to the Messenger of Allah (peace and blessings be upon him) to Sayyiduna Umar (may Allah be pleased with him), and he also continued to provide them protection over those two valleys.
Hadith 351
Sayyiduna ‘Attab bin Asid (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) ordered him to estimate the grapes as is done with dates, and to take the zakat of grapes in the form of dried grapes (raisins), just as the zakat of dates is taken in the form of dried dates.
Hadith 352
Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: When you estimate the yield of crops, then take zakat and leave a third; if you cannot leave a third, then leave a fourth.
Hadith 353
Amr bin Ya’la al-Thaqafi narrates from his father, and he from his grandfather, that a man came to the Messenger of Allah (peace be upon him) with a large gold ring in his hand. The Prophet (peace be upon him) asked: Do you pay zakat on it? He replied: What is its zakat? When he turned to leave, the Prophet (peace be upon him) said: It is a great ember. Abu Muhammad says that Walid bin Muslim narrated it from Sufyan, and Sufyan from Amr bin Ya’la al-Ta’ifi.
Hadith 354
Sayyiduna Abu Huraira (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: There is no zakat upon a Muslim for his personal horse and slave.
Hadith 355
Sayyiduna Abu Huraira (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: There is no zakat upon a Muslim for his personal slave and horse.
Hadith 356
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him) made the charity of Fitr obligatory in Ramadan, which is one sa’ of dates or barley upon every free or slave, male or female Muslim.
Hadith 357

عَبْدُ اللَّهِ بْنُ هَاشِمٍ ، قَالَ : ثَنَا
يَحْيَى يَعْنِي ابْنَ سَعِيدٍ ، عَنْ
دَاوُدَ بْنِ قَيْسٍ ، قَالَ : ثَنَا
عِيَاضٌ ، عَنْ
أَبِي سَعِيدٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " لَمْ نزل نُخْرِجُ الصَّدَقَةَ زَمَنَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ صَاعَ تَمْرٍ أَوْ زَبِيبٍ أَوْ أَقِطٍ أَوْ سُلْتٍ أَوْ شَعِيرٍ ، فَلَمْ نزل نُخْرِجُهُ حَتَّى كَانَ مُعَاوِيَةُ ، فَقَالَ : مَا أَرَى مُدَّيْنِ مِنْ سَمْرَاءِ الشَّامِ إِلا تَعْدِلُ صَاعًا مِنْ شَعِيرٍ ، قَالَ : فَأَخَذَ النَّاسُ بِهِ " .
Abu Sa'id al-Khudri (may Allah be pleased with him) reports that during the time of the Messenger of Allah (peace and blessings be upon him), we used to give one sa' of dates, raisins, cheese, dried yogurt, or barley as zakat al-fitr. This practice continued until the era of Mu'awiyah (may Allah be pleased with him). He said: I think that two mudd of wheat from Syria are equal to one sa' (of the above items). So the people started acting accordingly.
Hadith 358
Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) narrates that the above-mentioned narration is reported with the same chain. There is an addition in it that he said: I will always continue to give the same (one sa') as I have been giving until now.
Hadith 359
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him) ordered the giving of Sadaqat al-Fitr before the people go out to the Eid prayer place.
Hadith 360
Sayyiduna Ali (may Allah be pleased with him) narrates that Sayyiduna Abbas bin Abdul Muttalib (may Allah be pleased with him) sought permission from the Messenger of Allah (peace and blessings be upon him) to pay zakat before its due time, so the Prophet (peace and blessings be upon him) granted him permission for that. Yahya bin Ma'in says: Ismail bin Zakariya Khalaqani and Hajjaj bin Dinar Wasiti are both trustworthy.
Hadith 361
حَدَّثَنَا

أَبُو دَاوُدَ ، قَالَ : أَنَا
شُعْبَةُ ، قَالَ : أَنْبَأَنِي
عَمْرُو بْنُ مُرَّةَ ، قَالَ : سَمِعْتُ
عَبْدَ اللَّهِ بْنَ أَبِي أَوْفَى رَضِيَ اللَّهُ عَنْهُمَا ، يَقُولُ : " كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا تَصَدَّقَ إِلَيْهِ أَهْلُ بَيْتٍ بِصَدَقَةٍ صَلَّى عَلَيْهِمْ فَتَصَدَّقَ أَبِي بِصَدَقَةٍ إِلَيْهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اللَّهُمَّ صَلِّ عَلَى آلِ أَبِي أَوْفَى " .
Sayyiduna Abdullah bin Abi Awfa (may Allah be pleased with both of them) narrates that when any household would bring charity to the Messenger of Allah (peace and blessings be upon him), he would supplicate for them. My father brought charity to him, so the Messenger of Allah (peace and blessings be upon him) said: O Allah! Bestow mercy upon the family of Abi Awfa.
Hadith 362
حَدَّثَنَا
إِسْحَاقُ بْنُ مَنْصُورٍ ، قَالَ : ثَنَا
عَبْدُ اللَّهِ بْنُ نُمَيْرٍ ، قَالَ : ثَنَا
عُبَيْدُ اللَّهِ ، عَنْ
نَافِعٍ ، عَنِ
ابْنِ عُمَرَ ، عَنْ
عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ " أَنَّهُ حَمَلَ عَلَى فَرَسٍ فِي سَبِيلِ اللَّهِ ، فَأَعْطَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَجُلا ، فَوَقَّفَهُ الرَّجُلُ يَبِيعُهُ ، فَجَاءَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ لَهُ : أَبْتَاعُ الْفَرَسَ الَّذِي حَمَلْتُ عَلَيْهِ فِي سَبِيلِ اللَّهِ ؟ فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا تَبْتَعْهُ وَلا تَرْجِعْ فِي صَدَقَتِكَ " .
Sayyiduna Umar ibn al-Khattab (may Allah be pleased with him) narrates that he gave a horse in the way of Allah. The Messenger of Allah (peace and blessings be upon him) gave that horse to a man. That man put the horse up for sale, so Sayyiduna Umar (may Allah be pleased with him) came to the Messenger of Allah (peace and blessings be upon him) and asked: Should I buy the horse which I gave in the way of Allah? The Prophet (peace and blessings be upon him) said: Do not buy it, and do not take back your charity.
Hadith 363
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him) said: It is not permissible for a wealthy and able-bodied person who can work to take charity.
Hadith 364
Sayyiduna Abu Hurairah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: It is not permissible for a wealthy and able-bodied person to take charity.
Hadith 365
Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: Charity is not permissible for the wealthy, except for five types of people: (1) the one who collects zakat, (2) the person who buys charity with his own wealth, (3) the debtor, (4) the one striving in the way of Allah, (5) the poor person to whom charity is given and he gives it as a gift to a wealthy person.

عَبْدِ اللَّهِ بْنِ نَافِعٍ ، وَحَدَّثَنِي
مُطَرِّفٌ ، عَنْ
مَالِكٍ ، عَنْ
زَيْدِ بْنِ أَسْلَمَ ، عَنْ
عَطَاءِ بْنِ يَسَارٍ ، عَنْ
رَجُلٍ مِنْ بَنِي أَسَدٍ ، قَالَ : نزلت أَنَا وَأَهْلِي بِبَقِيعِ الْغَرْقَدِ ، فَقَالَ لِي أَهْلِي : اذْهَبْ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَلْهُ لَنَا شَيْئًا نَأْكُلُهُ ، وَجَعَلُوا يَذْكُرُونَ مِنْ حَاجَتِهِمْ ، فَذَهَبْتُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَوَجَدْتُ عِنْدَهُ رَجُلا يَسْأَلُهُ وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " لا أَجِدُ مَا أُعْطِيكَ " فَأَدْبَرَ الرَّجُلُ عَنْهُ وَهُوَ مُغْضَبٌ ، وَهُوَ يَقُولُ : لَعَمْرِي إِنَّكَ لَتُعْطِي مَنْ شِئْتَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّهُ لَيَغْضَبُ عَلَيَّ أَنْ لا أَجِدَ مَا أُعْطِيهِ مَنْ يَسْأَلْ مِنْكُمْ وَلَهُ أُوقِيَّةٌ أَوْ عَدْلُهَا ، فَقَدْ سَأَلَ إِلْحَافًا " ، قَالَ الأَسَدِيُّ : فَقُلْتُ : لَصحَتُنَا خَيْرٌ مِنْ أُوقِيَّةٍ ، قَالَ مَالِكٌ : وَالأُوقِيَّةُ أَرْبَعُونَ دِرْهَمًا فَرَجَعْتُ وَلَمْ أَسْأَلْ فَقَدِمَ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعْدَ ذَلِكَ شَعِيرٌ وَزَبِيبٌ فَقَسَمَ لَنَا مِنْهُ حَتَّى أَغْنَانَا اللَّهُ مِنْ فَضْلِهِ .
A man from Banu Asad said: I settled with my family in Baqi’ Gharqad. My family said: Go to the Messenger of Allah (peace be upon him) and ask him for something to eat for us. They began to mention their needs. I went to the Messenger of Allah (peace be upon him) and found a man asking him (for something). The Prophet (peace be upon him) was saying: I have nothing to give you. That man turned back angrily, saying: You give to whomever you wish. The Messenger of Allah (peace be upon him) said: He is angry with me because I have nothing to give. Whoever possesses one uqiyyah or its equivalent in wealth and still asks, his asking is unnecessary (ilḥāf). The Asadi said: I thought that our she-camel was worth more than one uqiyyah. Malik says: One uqiyyah is equal to forty dirhams. So I returned without asking. Later, when barley and dried dates came to the Messenger of Allah (peace be upon him), he gave us a share from it until Allah enriched us by His grace.
Hadith 367

سُفْيَانُ ، عَنْ
هَارُونَ بْنِ رِئَابٍ ، عَنْ
كِنَانَةَ بْنِ نُعَيْمٍ ، عَنْ
قَبِيصَةَ بْنِ مُخَارِقٍ ، قَالَ : " تَحَمَّلْتُ حَمَالَةً ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : نُؤَدِّيهَا عَنْكَ نُخْرِجُهَا إِذَا جَاءَ نَعَمُ الصَّدَقَةِ ، قَالَ : قَالَ : يَا قَبِيصَةُ " إِنَّ الْمَسْأَلَةَ حُرِّمَتْ إِلا فِي إِحْدَى ثَلاثٍ : رَجُلٌ تَحَمَّلَ بِحَمَالَةٍ فَحَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُؤَدِّيَهَا ثُمَّ يُمْسِكَ ، وَرَجُلٌ أَصَابَتْهُ جَائِحَةٌ اجْتَاحَتْ مَالَهُ فَحَلَّتْ لَهُ الْمَسْأَلَةُ فَهُوَ يَسْأَلُ حَتَّى يُصِيبَ سِدَادًا مِنْ عَيْشٍ أَوْ قِوَامًا مِنْ عَيْشٍ ثُمَّ يُمْسِكَ ، وَرَجُلٌ أَصَابَتْهُ حَاجَةٌ وَفَاقَةٌ حَتَّى يَشْهَدَ ثَلاثَةٌ مِنْ ذَوِي الْحِجَى مِنْ قَوْمِهِ فَحَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُصِيبَ سِدَادًا مِنْ عَيْشٍ أَوْ قِوَامًا مِنْ عَيْشٍ ثُمَّ يُمْسِكَ ، وَمَا سِوَى ذَلِكَ مِنَ الْمَسْأَلَةِ فَهُوَ سُحْتٌ " .
Sayyiduna Qabisah bin Mukhariq (may Allah be pleased with him) narrates that I accepted the responsibility of a guarantee, so I presented myself before the Messenger of Allah (peace and blessings be upon him). He (peace be upon him) said: When the camels of zakat come to us, we will pay it on your behalf. Then he said: O Qabisah! Asking (for charity) is only permissible for three types of people: (1) The person who has accepted someone’s guarantee; it is permissible for him to ask until he pays it off, then he should stop asking. (2) The person who is struck by a calamity that destroys all his wealth; it is permissible for him to ask until he fulfills his basic needs, then he should stop asking. (3) The person who is in severe need and hunger, to the extent that three wise men from his people testify to his condition; it is permissible for him to ask until he fulfills his basic needs, then he should stop asking. Other than this, asking is forbidden.
Hadith 368
حَدَّثَنَا
أَبُو هَاشِمٍ زِيَادُ بْنُ أَيُّوبَ ، قَالَ : ثَنَا
إِسْمَاعِيلُ يَعْنِي ابْنَ عُلَيَّةَ ، قَالَ : ثَنَا
ابْنُ عَوْنٍ ، عَنْ
نَافِعٍ ، عَنِ
ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، قَالَ : أَصَابَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ أَرْضًا بِخَيْبَرَ ، فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَاسْتَأْمَرَهُ فِيهَا ، فَقَالَ : " يَا رَسُولَ اللَّهِ أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ مَالا أَنْفَسَ مِنْهُ ، قَالَ : " إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا " قَالَ : فَتَصَدَّقَ بِهَا عُمَرُ رَضِيَ اللَّهُ عَنْهُ ، أَنَّهُ لا يُبَاعُ أَصْلُهَا وَلا تُوهَبُ وَلا تُورَثُ ، فَتَصَدَّقَ بِهَا فِي الْفُقَرَاءِ وَفِي الْغُرَمَاءِ وَفِي الرِّقَابِ وَفِي سَبِيلِ اللَّهِ وَابْنِ السَّبِيلِ وَالضَّيْفِ ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that Sayyiduna Umar (may Allah be pleased with him) acquired a piece of land in the region of Khaybar. He came to consult the Messenger of Allah (peace and blessings be upon him) and said: O Messenger of Allah! I have obtained such land in Khaybar that I have never acquired wealth better than it. The Prophet (peace and blessings be upon him) said: If you wish, withhold its original (property) and give its produce as charity. So Sayyiduna Umar (may Allah be pleased with him) gave it as charity, stipulating that its original would neither be sold, nor gifted, nor inherited. Its produce was to be given in charity to the poor, the indebted, for the freeing of slaves, in the way of Allah, to travelers, and to guests. There is no harm for the one who manages the land to eat from it in a reasonable manner or to feed a friend, provided he does not accumulate wealth from it.
Hadith 369
حَدَّثَنَا
زِيَادٌ ، قَالَ : ثَنَا
إِسْمَاعِيلُ ، قَالَ : ثَنَا
أَيُّوبُ ، عَنْ
نَافِعٍ ، نَحْوَ حَدِيثِ ابْنِ عَوْنٍ ، وَقَالَ : يَلِيهَا ذُو الرَّأْيِ مِنْ آلِ عُمَرَ .
Ayyub narrated from Nafi‘ in the same manner as Ibn ‘Awn and said: The overseer of this land will be a person of sound judgment from among the family of ‘Umar.
Hadith 370
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: When a person dies, his deeds come to an end except for three things: (1) ongoing charity, (2) knowledge from which people benefit, (3) a righteous child who prays for him.
Hadith 371
Sayyiduna Bilal bin Harith (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) collected zakat from the mines of Qabliyyah.
Hadith 372
حَدَّثَنَا
ابْنُ الْمُقْرِئِ ، قَالَ : ثَنَا
سُفْيَانُ ، قَالَ : أَوَّلُ مَا رَأَيْتُ
الزُّهْرِيَّ سَأَلْتُهُ عَنْ هَذَا الْحَدِيثِ ، فَحَدَّثَنِي ، قَالَ : ثَنِي
سَعِيدٌ ،
وَأَبُو سَلَمَةَ ، أَنَّهُمَا سَمِعَا
أَبَا هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، يُحَدِّثُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ : " الْعَجْمَاءُ جَرْحُهَا جُبَارٌ وَالْمَعْدِنُ جُبَارٌ ، وَفِي الرِّكَازِ الْخُمُسُ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: The wound caused by an animal is pardoned, the blood of one who dies by falling into a well is pardoned, and there is a fifth (one-fifth zakat) in buried treasure.

أَبُو الْوَلِيدِ ، قَالَ : ثَنَا
حَمَّادُ بْنُ سَلَمَةَ ، عَنْ
حُمَيْدٍ ، عَنِ
الْحَسَنِ ، عَنْ
عُثْمَانَ بْنِ أَبِي الْعَاصِ رَضِيَ اللَّهُ عَنْهُ ، أَنَّ وَفْدَ ثَقِيفٍ قَدِمُوا عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَنْزَلَهُمُ الْمَسْجِدَ لِيَكُونَ أَرَقَّ لِقُلُوبِهِمْ ، فَاشْتَرَطُوا عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ لا يُحْشَرُوا وَلا يُعْشَرُوا وَلا يُجَبُّوا وَلا يُسْتَعْمَلَ عَلَيْهِمْ مِنْ غَيْرِهِمْ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا تُحْشَرُونَ وَلا تُعْشَرُونَ وَلا يُسْتَعْمَلُ عَلَيْكُمْ غَيْرُكُمْ ، وَلا خَيْرَ فِي دِينٍ لَيْسَ فِيهِ رُكُوعٌ " .
Sayyiduna Uthman bin Abi al-As (may Allah be pleased with him) narrates that the delegation of Banu Thaqif came to the Messenger of Allah (peace and blessings be upon him). The Prophet (peace and blessings be upon him) accommodated them in the mosque so that their hearts might soften. They set a condition upon the Prophet (peace and blessings be upon him) that they be exempted from jihad, ushr (tithe), and prayer, and that no ruler be appointed over them except from among themselves. The Prophet (peace and blessings be upon him) said: You are exempted from jihad and ushr, and no ruler will be appointed over you except from among yourselves, but there is no good in a religion in which there is no bowing (prayer).
