حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ، قَالَ: ثَنَا عُثْمَانُ بْنُ عُمَرَ، قَالَ: ثَنَا يُونُسُ، عَنِ الزُّهْرِيِّ، قَالَ: كَانَ رِجَالٌ مِنَ الْأَنْصَارِ مِنْهُمْ أَبُو سَعِيدٍ الْخُدْرِيُّ وَأَبُو أَيُّوبَ يَقُولُونَ: الْمَاءُ مِنَ الْمَاءِ وَيَزْعُمُونَ أَنَّهُ لَيْسَ عَلَى مَنْ مَسَّ امْرَأَتَهُ غُسْلٌ مَا لَمْ يُمْنِ، فَلَمَّا ذُكِرَ ذَلِكَ لِعُمَرَ وَعَائِشَةَ وَابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمْ أَبَوْا ذَلِكَ فَقَالُوا: إِذَا مَسَّ الْخِتَانُ الْخِتَانَ فَقَدْ وَجَبَ الْغُسْلُ، فَقَالَ سَهْلٌ الْأَنْصَارِيُّ وَقَدْ أَدْرَكَ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَهُوَ ابْنُ خَمْسَ عَشْرَةَ سَنَةً فِي زَمَانِهِ: حَدَّثَنِي أُبَيُّ بْنُ كَعْبٍ رَضِيَ اللَّهُ عَنْهُ " أَنَّ الْفُتْيَا الَّذِي كَانُوا يَقُولُونَ: الْمَاءُ مِنَ الْمَاءِ كَانَتْ رُخْصَةً رَخَّصَ بِهَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي أَوَّلِ الْإِسْلَامِ ثُمَّ أَمَرَ بِالِاغْتِسَالِ بَعْدُ " وَقَدْ كَانَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ أَخَذَ بِذَلِكَ عَنْ رَجُلٍ مِنَ الْأَنْصَارِ فَلَمَّا بَلَغَهُ الْعِلْمُ اغْتَسَلَ وَأَمَرَ بِالِاغْتِسَالِ.
Sayyiduna Abu Sa‘id Khudri and Sayyiduna Abu Ayyub Ansari (may Allah be pleased with them both), along with some other Ansari companions, used to say: “Water (i.e., ritual bath) is due to water (i.e., ejaculation).” They also used to say: “A man is not obligated to perform ghusl (ritual bath) if he touches a woman, unless ejaculation occurs.” When this was conveyed to Sayyiduna ‘Umar, ‘Abdullah ibn ‘Umar, and Sayyidah ‘A’ishah (may Allah be pleased with them), they refuted it and said: “If the private part (of a man) meets the private part (of a woman), then ghusl becomes obligatory.” Sayyiduna Sahl ibn Sa‘d (may Allah be pleased with him), who met the Prophet (peace and blessings be upon him) at the age of fifteen, narrates: Sayyiduna Ubayy ibn Ka‘b (may Allah be pleased with him) informed me that the fatwa of «الْمَاءُ مِنَ الْمَاءِ» was a concession from the Messenger of Allah (peace and blessings be upon him) at the beginning of Islam; later, he commanded the performance of ghusl. ‘Abd al-Malik ibn Marwan (may Allah have mercy on him) had derived this ruling from an Ansari; when he learned about the obligation of ghusl, he himself began to perform ghusl and started commanding others to do so.
