باب حد الزاني البكر والثيبPunishment for fornicator, married and unmarried
Hadith 819
حَدَّثَنَا عَلِيُّ بْنُ خَشْرَمٍ ، قَالَ : أنا عِيسَى يَعْنِي ابْنَ يُونُسَ ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : جَاءَ مَاعِزٌ الأَسْلَمِيُّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : إِنِّي قَدْ زَنَيْتُ ، فَأَعْرَضَ عَنْهُ حَتَّى قَالَ ذَلِكَ أَرْبَعَ مَرَّاتٍ ، فَقَالَ : " اذْهَبُوا بِهِ فَارْجُمُوهُ ، فَذَهَبَ ، فَلَمَّا رُجِمَ وَجَدَ مِنَ الْحِجَارَةَ فَرَّ يَشْتَدُّ ، فَمَرَّ بِرَجُلٌ مَعَهُ لِحْي بَعِيرٍ فَضَرَبَهُ فَقَتَلَهُ ، فَذَكَرُوا فِرَارَهُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِينَ وَجَدَ مَسَّ الْحِجَارَةِ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَفَهَلا تَرَكْتُمُوهُ ؟ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that Sayyiduna Ma'iz Aslami came to the Messenger of Allah (peace and blessings be upon him) and said: I have committed adultery. The Prophet turned away from him until he had confessed this four times. Then the Prophet (peace and blessings be upon him) said: Take him away and stone him. So they took him, and when the stoning began, due to the pain from the stones, he ran away. He passed by a man who had a camel's jawbone, and that man struck him with it and killed him. The people mentioned to the Prophet (peace and blessings be upon him) that he had run away due to the pain of the stones, so the Prophet (peace and blessings be upon him) said: Why did you not leave him?
