Hadith 774
حَدَّثَنَا إِبْرَاهِيمُ بْنُ عَبْدِ اللَّهِ النَّيْسَابُورِيُّ ، قَالَ : أنا يَزِيدُ بْنُ هَارُونَ ، قَالَ : أنا مُحَمَّدُ بْنُ إِسْحَاقَ ، عَنِ الْحَارِثِ بْنِ فُضَيْلٍ ، عَنْ سُفْيَانَ بْنِ أَبِي الْعَوْجَاءِ السُّلَمِيِّ ، عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " مَنْ أُصِيبَ بِدَمٍ أَوْ خَبْلٍ ، وَالْخَبْلُ الْجُرْحُ ، فَهُوَ بِالْخِيَارِ بَيْنَ إِحْدَى ثَلاثٍ ، فَإِنْ أَرَادَ الرَّابِعَةَ فَخُذُوا عَلَى يَدَيْهِ بَيْنَ أَنْ يَقْتَصَّ ، أَوْ يَعْفُوَ ، أَوْ يَأْخُذَ الْعَقْلَ ، فَإِنْ أَخَذَ مِنْ ذَلِكَ شَيْئًا ثُمَّ عَدَا بَعْدَ ذَلِكَ ، فَإِنَّ لَهُ النَّارَ خَالِدًا مُخَلَّدًا فِيهَا " .
Sayyiduna Abu Shurayh Khuza’i (may Allah be pleased with him) narrates that I heard the Messenger of Allah (peace and blessings be upon him) say: Whoever is killed or wounded, his heirs have the right to choose one of three things: they may take retribution (qisas), forgive, or accept blood money (diyah). If they intend a fourth option, restrain their hand. Whoever exceeds the limit after taking any of these rights will abide forever in Hell.
