Hadith 634

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْحَكَمِ ، أَنَّ ابْنَ أَبِي فُدَيْكٍ ، أَخْبَرَهُمْ ، قَالَ : وَثَنَى ابْنُ أَبِي ذِئْبٍ ، قَالَ : ثنى أَبُو الْمُعْتَمِرِ بْنِ عَمْروٍ ، عَنِ ابْنِ خَلْدَةَ الزُّرَقِيِّ وَكَانَ قَاضِيَ الْمَدِينَةِ ، قَالَ : جِئْنَا أَبَا هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ فِي صَاحِب لَنَا أَفْلَسَ ، فَقَالَ : هَذَا الَّذِي قَضَى فِيهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَيُّمَا رَجُلٌ مَاتَ أَوْ أَفْلَسَ فَصَاحِبُ الْمَتَاعِ أَحَقُّ بِمَتَاعِهِ إِذَا وَجَدَهُ بِعَيْنِهِ " .
Abu Khaldah Zarqi (may Allah have mercy on him) narrates that we brought a case concerning one of our companions, who had become insolvent, to Abu Hurairah (may Allah be pleased with him). He said: "In a similar case, the Messenger of Allah (peace and blessings be upon him) gave this ruling: Whoever dies or becomes insolvent, the owner of the goods is more entitled to his goods, provided that the goods are exactly as they were."
