Hadith 626
حَدَّثَنَا بَحْرُ بْنُ نَصْرٍ ، عَنِ الشَّافِعِيِّ ، قَالَ : ثنا مُسْلِمُ بْنُ خَالِدٍ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْها ، أَنَّ رَجُلا اشْتَرَى عَبْدًا فَاسْتَغَلَّهُ ثُمَّ ظَهَرَ مِنْهُ عَلَى عَيْبٍ ، فَخَاصَمَ فِيهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَضَى لَهُ بِرَدِّهِ ، فَقَالَ الْبَائِعُ : يَا رَسُولَ اللَّهِ ، إِنَّهُ قَدْ أَخَذَ خَرَاجَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْخَرَاجُ بِالضَّمَانِ " .
Lady Aisha (may Allah be pleased with her) narrates that a man bought a slave and derived profit (income) from him. Then a defect was discovered in the slave. That man came to the Messenger of Allah (peace and blessings be upon him) disputing, so the Prophet decided to return the slave. The seller said, "O Messenger of Allah! He has already received profit from the slave." The Messenger of Allah (peace and blessings be upon him) said, "The one who is liable for loss is entitled to the profit."
